Can anyone tell me if a person gets a criminal record if they receive a conditional sentence?

Yes, they do. My husband recieved a conditional sentence in September and violated his conditions and is now in prison till August if parole goes through or March 2007 if not. It is the exact same as a regular charge on your record the only difference is that you serve it in the community (supposed to cut back on the prison population for offenses that are not serious but that is not always the case, as my husband is a violent offender and he received one). The only time it will not show up on your record (for employers etc but is still there for police etc.) is a conditional discharge which means it is not technically on your record if you meet certain conditions for a certain length of time.

Also usually a conditional discharge has conditions which are usually involving good behaviour for a period of time and then the sentence is wiped from the record though authorities can still access this info. As Nicole said, any other kind of conditional sentence is a criminal record.

Yes, a conditional sentence is a criminal sentence, just that it is served at home and in the community.
