My husband is in prison right now. He gets out in november and we have been trying to get custody of his daughter. I just found out today that she is back here in Polk county florida and I need some information about getting custody of her or at least trying to get some type of rights to her so the mother cant hold her over his head anymore. She was at one time a drug addict and I dont know how many times she has signed over custody of her kids to her parents or someone else. This child is going to grow up and be on drugs or something worse. They say theres nothing that I can do now but we need to do something and nobody can help me. Any kind of information would help. Thank you.

Legally, you are not a relative so there isn't anything you can do. I would imagine that your husband will need to ask for custody when he is free to do so. He certainly can't do anything about it from prison. You might contact Social Services (or who ever would be helpful in getting custody) now to do the research so that when your husband gets home, trying to get his daughter can become a priority issue with him.
Please keep in mind that he'll probably have to show that he can afford to provide for her, so may need to find a job first. There will probably be other stipulations as well. Anyway, find out what the law is in your state and have all the research done before your husband gets home. Good luck to you!

Thank you. I have done as much as I can which is why I was trying to find out more. Someone has told my husband that public warehouse hires felons so he was going to apply there or go back to masonry which he has done for years and would be able to go back with no problem. I guess I just need to save up the lawyer for when he gets out. The courts did tell me however that the month before he is released he will be brought back for another court date to determine when the following court date will be so it can be brought before the judge of whos living where and whos got a job and blah blah...then we will have the lawyer and hopefully everything worked out. Thank you for your help.
