View Full Version : Parole violation laws in Alabama

Does anyone have any idea what happens to a parolee when they violate parole with a DUI? My man has been arrested on that violation by his PO and he is waiting for his parole hearing in 2 weeks. They will either decide to slap him on the "wrist" or give him up to 5 years. This is his first DUI and I have heard from other sources that they won't make him serve the rest of his sentence behind bars but it really is all just speculation. I am just trying to prepare myself for the worst. What has me confused is his actual hearing for the DUI is July 30 but instead of waiting if he was found guilty his PO arrests him anyway just because he was arrested by the officer a week before. Any input would be appreciated. Thanks.

Any time that you are on parole and come in contact with the police, it's a violation and they can send you back. My fiance was revoked after 7 years on parole, for not going to see his parole officer. They set his hearing date, revoked him and said that he will not be eligible again for 18 months. He has been locked up since 3/07/02 and is not expected to come up for parole again til 11/03. Sorry that I could not give you any encouraging information but, with the way things are in Alabama right now, there's no telling what will happen! Good luck to you and your honey.

I have visititation with him today and I can't bear this for much longer. They won't ;et us hug or see each other. We have to talk over a screen with a phone. I feel so alone and it has been only 2 weeks since he's been locked up. The worrying about how bad he might get punsihed is driving me crazy. I keep telling myself that it won't be that bad but I don't know anything about the Alabama parole board. I told his lawyer to do whatever she could do to keep him out of prison. I don't know if that was a good thing or bad thing to suggest to her. If he gets sent back I don't have a clue how I am going to pay for everything by myself. I just miss him so much, he made me feel safe being around. Thanks for the info. I will just keep on praying and taking one day at a time.

Getting a DUI amounts to getting a new charge, and when you're on parole, you stand a high risk of being violated and sent back for that. Other things like not reporting to the PO, not looking for work, the PO finding you drinking if you're not supposed to----those are things they're likely to just slap you on the wrist for and let you cool your jets in jail for a few days to get their point across. They'll do that about three times out here for stuff like that. But a DUI is a new charge and that's probably why the PO put him in jail again. Also, most parole contracts stipulate no substance use, so a DUI does prove there was that, of course. The stipulation against using alcohol and drugs on parole is put there not to spoil a person's fun----it's there because the overwhelming majority of crime is committed while under the influence or in some other way involving alcohol and drug use. A person on parole is actually considered to be still in custody, so just like the custody levels on the inside, if a prisoner demonstrates they can't live within the boundaries of that level of custody, then DOC will up them to a closer custody level for awhile again, till they again earn their way back down.

not to make you worry, but chances are he's going back to prison...its a new cases, and even if the prisons are overcrowded and broke, the parole board don't give a *hit. My boyfriend was on parole after serving 15 years. within two years he owned a very good business, built a home, married, had a child on the way. After 9-11 his business went under, this new wife (now divorced) lost her baby, lost his house and he ended up using drugs. One bad piss test and off he went, no questions asked. They sent him back for 12 months the one thing about that is the parole board is running 14 months behind on viotent offenders so even after he does 12 months its another 14 months before the parole board will review him again...provided that they don't get even further behind. So I would advise you to find a "GREAT" DUI lawyer and fight like hell.....

I'm sorry about your boyfriend DeniseJ. Well, I visited Kevin today and he said that he talked to his lawyer yesterday and that she is saying there is a real good chance that he won't go back for over 1 year. But that she is trying to get some kind of residential substance abuse program for him to attend to. He doesn't like this idea because he has never had an alcohol or drug problem and he doesn't want the PB to get that impression of him. I told him that they will already have that impression of him when they hear of the DUI arrest and that he needs to face the facts that going to an alcohol rehabilitation home is better than prison. He told me to quit worrying and to have faith that our love will get us through this. I guess it will get easier once we know for sure. Thanks all for the info and good luck to you and your men.

Hey,

First, welcome to PTO. I went through the same thing you are going through and honestly still going through it. I also have to deal with Etowah county. I could help you better if you were willing to tell me who his Parole officer is, who his lawyer is, if he has went to court on the new charge, who was/will be the judge. As awful as it is these will all play a factor in what happens next when dealling with Etowah county. I'll be glad to tell you my story as well. Personal friend done 4 YEARS,for parole violation due to PUBLIC DRUNKNESS,he was in a parked car,passed out.He has served 4 years in prison.YEAP-This is ALABAMA for ya.
Alabama parole board is unbelievable and cold hearted as *hit!
