View Full Version : Questions about parole violations
dmceeswoman 02-12-2006, 09:25 PM I am new to this site and wanted to say this is a great thing that this website offers. I wanted to ask where would I go to ask about parole violations. Do you have any idea? Could you direct me where to go here on prisontalk?
Thank you,

What kind of question do you have? Why don't you go ahead and ask it here and hopefully someone can help you.
denverswife 02-15-2006, 06:19 PM Try the California Forum. We have a subforum specifically about probation and parole in California.
dmceeswoman 02-15-2006, 09:17 PM My question was if my fiance is coming home tomorrow on an electronic monitor his parole officer said he will have a NIC hearing(not in custody). That is when the commission can decide since he has violated his parole (DUI)then he can call him back into custody immediately. The p.o. said this could happen within 6 days. Why do you think then they are letting him be released from Chino if only within a few days he can be back in custody? Sounds a little strange to me.
Any ideas?
Lonleydee 02-15-2006, 10:06 PM im not really sure, but he may have to go before the parole board. my bf was on electronic monitoring and he came in late,(he violated his parole). he was taken into custody and now he has to stay until Aug06. if u have any other questions, just email me.
Momosgrl 02-15-2006, 10:09 PM My finance violated parole and was allowed to make bail on te new charge..the parole board is completely seperate and is allowed to work there case to come to their own decision on punishment..it is sad but the fate is really up to them..yes they can take him in that day , thats what happened to me..I am waiting for in to come home from an 18 month parole violation sentence....
dmceeswoman 02-17-2006, 12:57 AM Well he never made it home tonight. I guess the parole officer lied because he told me he would be out on Thursday. Here it is thursday night and he isnt here. I know they wont release him on Friday becuz the p o said he would have to check in with the officer of the day on friday becuz he would not be in. Holiday on Monday, so I am totally bummed.:(
denverswife 02-20-2006, 02:52 PM The PO has very little say on when the prison releases. Don't count on him not getting released sometime this weekend. My husband was released on the Saturday of a 3 day weekend, in spite of the PO saying there was NO WAY.

denverswife 02-20-2006, 11:44 PM Does anyone know whether the 10 days they have to have a probable cause hearing are calendar days or working days? Like wise the 45 days to the hearing? And what do I do if/when they go over? I've been through about a half dozen violations with him and NEVER has he had a hearing in 45 days. Once, about 3.5 years ago, it was 102 days!!

It's calendar days.
kristinam79 02-21-2006, 11:36 AM as far as I know it's business days. I remember when my husband has his parole revoked, he has like 10 days to get a response of whether they were going to violate him or not, and then once he got screened he had to wait another few weeks to get in front of the board. he was arrested on 4/21/04, and then released 5/27/04 so it all took a little over a month..
I am sorry you are going through this, I hope things work out for you guys
Cubana 02-21-2006, 03:34 PM calander days. the law has changed. 45 days from start to finish.
denverswife 02-21-2006, 03:59 PM Thanks everybody.
He was picked up Saturday, so that was the 18th. At least now I have a general idea, if he still doesn't get released today or tomorrow. I know the County doesn't like to keep them, they want them shipped to High Desert or let out.
dmceeswoman 02-24-2006, 08:00 PM He was released on Friday night from chino and came home and spent 5 days here and the parole officer called yesterday and told him the commissioner wanted him put back in. The electronic monitor was going to be the first used in this parole office. The commissioner didn't even let that happen. Now he had to be put through this all over again. Wait for 35 days to see how much time you'll get.
