View Full Version : Is it easier to transfer counties before or after release?
misssusiequsie 01-25-2006, 05:21 PM Okay me and my man will be getting married before he gets released so he will be moving with me when he gets out. He is from San Bernardino County and I live in Ventura County. Now my question is: Is it easier for him to transfer parole before he gets out or after?f:rolleyes: :thumbsup:
John S. 01-25-2006, 06:28 PM He cannot transfer his parole before he gets out. That's entirely up to his agent and the region he wants to transfer to. This is always an "if" situation. Good luck.
I don't understand, I know two men that just got their transfer papers and they are still in prison. One is going out of state and the other is changing counties. Could someone please explain more?. Barb
kristinam79 01-25-2006, 09:39 PM if he is still in prison he can put your address on his parole papers and request an out of county transfer, but I think they verify if your married. When i called the first thing they askedme was if I was legally married.

denverswife 01-26-2006, 09:18 PM And don't let him come home to you before it gets changed. They can and will violate him before the door closes behind you. He will need permission from his parole agent EVERY time he leaves his county to come to yours. And it's up the the agent whether or not he can stay over night, or over a weekend. Try getting him a guaranteed job for his release, they seem to like that best of all. I have personal knowledge of a case where a legally married couple were forced to live in two different counties. He wasn't allowed to live in her county and her job prevented her mocing to hers.

Are you referring to prison transfers? If so, it is highly unlikely that they will transfer him to a prison out of state. The only time they'll do this is for high (extremely high) security reasons and that's an admin iniation, not at the request of the inmate or a loved one.

No, What I meant was can they transfer his parole to Washington State from California?
NuBeginning 02-19-2006, 02:45 AM Yes, he can get a mandatory parole transfer if he meets the Interstate Compact criteria of having family (as recognized in the compact agreement) or a spouse in the state he wants to transfer to. If he doesn't meet the criteria (having family or spouse), then he can get a discretionary transfer at the request of the sending state, but it's at the receiving state's discretion as to whether or not they will accept it.
To recap, when you meet the criteria as listed in the compact agreement, it's mandatory that both states accept the transfer. If not, the sending state can request it if they so chose, but the receiving state is not obligated to accept it; it's at their discretion.

I have a question for you about the two men that you mentioned who got their transfer papers while still in prision. How far before his release date did the man with the county transfer get his papers?
Basically I wanted to know whether it was part of the normal 6 months before release parole process or was it something he worked on prior to that point.

the 6 month pre parole process is pretty much just where they fill out the paperwork to send out to the region. The main form is one called a 611 document, that has all the info and the address where he will be going to. The parole paperwork cannot leave the institution prior to 150 days before the release date. Myhusband did his in December, and the records department ended up holding it until 2/13/06 so that it wouldnt be any sooner then 150 days.
