Alright, I just found out that he went to court today and the judge was going to suspend all of his time but didn't because she didn't know his guidlines. He may be coming home in June of this year instead of 2008...how do I find out his guidelines and is there anything else I should do to make this process go any faster? I need some ideas, please help.:eek: :eek:

when he talked to his attorney today he said something about looking it up-but i don't know if it is something that only his attorney can do or if it is something we can do on our own. the funny and weird thing is, is that the judge who sentenced him wrote the guidelines and gave my man 2 extra years OVER the guidelines. so i am lost as to where they are getting the information. yes, as soon as i know something i will let you know.

I happen to know about all this. You can go to the Sentencing Commision's website:

http://www.vcsc.state.va.us/codes_qbe.cfm

Type in the offense and you can see what the guidelines are. Now the judge can go anywhere in those guidelines, use the minimum or maximum without even giving a reason. If he wants to go outside of them, he has to give a reason. Example, there are priors and was excessively violent, he can add time. If its a first offense, they cooperated, they can go under the guidelines. It all comes down to the judge, unfortunately. Holler if you need any more help. Good luck.

thank you for posting that i found out what one of his guidelines was but i am having trouble with the second one. so if the judge gave him 10 years with 8 suspended, and he goes back in front of the judge to get the 2 years run concurrent with is present time is that possible? or am i heading down the wrong path here and getting my hopes up?

hey i would like to know how you would get it to go back before the judge, i have written to him twice and he said he has nothing to do with it as well as the commonwealth and the govenor as well and nothing has been done if they had of run concurrent he would be out, a year ago, i am very upset about this but where do you turn to for help in this state,they play games with peoples lives to much, but doug told me he heard the commonwealth attorney say we want a example, so they 9yrs instead of 3yrs, three separate charges, if they were concurrent he would be out now which is so said, and they put him two hours away which is hard to get away for four hours driving time then whatever time you spend thier, so it is a whole day, you know i love him so much but, what we both have been threw in the system stinks. i hate the system so bad because a judge can really do what he wants and doesn't care, which stinks thier is nothing we can do about this at all. just consider mostof them are men, who want to boss someone, and this is thier way and another thought they are lawyers who couldn't make it as a lawyer so they became a judge to earn a living preying on us working class people, because we support our loved ones in jail, we do not the system they don't pay for nothing they don't have to really.

I so hear what you are saying. It truly does suck. From what I know, if they are still in the regional/county jail where they were sentenced, you can ask for a modification in sentencing but you have to have some grounds for it. That usually isn't hard to figure something out. Once they get moved into the DOC, they become property of the state and no one else can modify a sentence except the governor. I am not real convinced of this and am still checking. I know the Attorney General's office told me that there is no way he can change sentences and they told me to contact the governor. I read somewhere that the Director of the DOC can modify sentences, but it is mostly to clear beds and handle population better. Example, he can let someone out early to free his bed or move them to lesser facility on work release, etc.

This has become my main objective and I will keep you posted if I find out anyone else can modify or reduce a sentence. State legislators can't and won't help.

ok then if thier is nothing that we can do, we all need to protest the system, the men in office, thier needs to be a change for all of us, i know haynesville is a bunch of shit, everytime i go, and all of these women think they are better than us, go figure i make more than she does i know that all to well. ok we need to kick some ass everywhere not just in richmond, but in our home towns as well.

I agree. That is why these good conduct/literacy bills are so important. It lets the inmates change their paths in prison and work hard to get out sooner. Those that dont' want to change, won't get out sooner. To me, it is a win-win situation. I am going to try to get to that General Assembly thing tommorrow and hopefully get to read what I have been writing. I saw on the news yesterday that all open talk was on money for social services. It went on for two hours. If I do speak, it will be straight to the point and hopefully I can plant a seed.

Change starts when one or more people get together and say "you know, that just isn't right, we need to change this"

hey i want you to give it your all, i can't be thier i wished i could i live in charlottesville, which is so far away from downtown richmond, and i would be thier if i could, but i can't afford to loose time from work at all, and they are so picky about the time we take off. but give it your all and one for me as well. good luck
