`How long do you stay in reception?
Can be anywhere from a few weeks to a few months. All depends on Albany. It depends on when an "appropriate" bed opens up, rather than being a fixed time.

When can they call me when transfered?
How long will it be till I can go visit him? Him to call me?

Usually they can call once they are in general population. Call the prison to see when you can visit. The only wait for visits is while they are in Reception--unless they are in SHU.

Also, you need to set up a collect call account with inmate services for MCI or he will not be able to call you. You must have a landline and it cannot be cable service or a cell.

How can they call me? How do calls work for our loved ones?

For State Correctional Max and Medium facilities:

They must call you collect, basically MCI handles all the collect call in New York and calls are about $7.80-8.60 for 30 mts. You can call MCI, or you can call your local telephone company to have this turned on. I pay through my company Verizon.

The number for MCI is 800-2310193 Make sure you don't the have the caller block option/anonymous call rejection enabled on your phone. You may have to fax them proof of ID.

Can you use cell phones?

No

NYS DOCS Inmate Rulebook, rule 121.11: Inmate telephone calls and telephone conversations shall be restricted to the telephone number dialed or otherwise placed by or for the inmate. Telephone call forwarding or other third party phone calls or the use of credit card calls are prohibited. This is a Tier 1 or 2 infraction.


How can I send money and food?

Sending Money

Check or MO by MAIL no cash....you can overnight the money through the post office to get there faster. go to the Post Office get a money order - send it overnight--the post office delivers to PO boxes overnight. He will get it as soon as he would if you dropped it off. You can enclose it in a letter, they will take it out and credit his account.

Make it payable to him WITH his DIN next to his name!

Visitors may leave funds for deposit only to the account of the inmate they are visiting. Funds may be received in cash, check or money order, but shall be limited to $50 per inmate per day, regardless of the number of visitors transmitting funds. The Deputy Superintendent of Administration shall employ appropriate fiscal policies and procedures to insure accountability of monies received.

Visiting A Prisoner

Entrance Rules and Procedures

Inmates and their authorized visitors will be expected to abide by the facility's rules and regulations and to follow the instructions and guidelines given by facility staff. Violation of these rules and procedures by visitors may result in the denial of a visit and the suspension or revocation of future visits.

ALL VISITORS shall be provided with written notification of the visiting rules; however, it will be considered sufficient notice if such rules are conspicuously posted.

Identification

Visitors to a correctional facility will be required to furnish proof of identification. Failure to produce adequate identification shall result in the denial of a visit. Prior to visiting, visitors shall sign appropriate visiting forms as required by the facility. These records will be maintained by the facility.

Adequate identification shall consist of any of the following:

Signature Card (credit card, social security card, employment ID, welfare card, drug program card, Armed Services I.E., driver's license, motor vehicle registration, or any other similar document with the visitor's signature on it).


Birth or baptismal certificates shall not be considered adequate identification for an adult visitor; however, they may be used as identification for a minor child. Absent any other creditable documentation, an adult approved to visit may vouch for the identification of a minor.


To participate in Family Reunion Program visits, a spouse must possess documentation of a valid marriage license or a declaratory judgment stating the validity of an out-of-state common-law marriage.
Each visitor may be hand stamped upon entry to a facility to aid in the identification of visitors leaving the facility.

Contraband

All visitors shall be searched upon entry to a facility to aid in the identification of visitors leaving the facility.

Any article or thing the possession of which would constitute an offense under any law applicable to the public.


Any article or thing which is readily capable of being used to cause death or serious physical injury, including but not limited to a hand gun, shoulder gun, cartridge, knife, explosive, or dangerous drug (including marijuana).

Any article or thing that is introduced into a correctional facility under circumstances evincing an intent to transfer same to an inmate without the permission of the Superintendent or his designee; or

Any article or thing that is not specifically authorized to be possessed by an inmate in a State correctional facility pursuant to the rules of the Department or the local rules of the facility (alcohol and money are among the items inmates are not permitted to possess).
Sobriety Visitors appearing to be intoxicated or under the influence of drugs will not be admitted to a correctional facility.

Attire

Visitors appearing in inappropriate attire will not be admitted to a correctional facility. The following are unacceptable: see-through clothing, bare midriffs or backs, plunging necklines, short-shorts, or athletic shorts, bare feet, and bathing suits. If in doubt, the visitor should not wear a questionable item of clothing.

Medication

Visitors having medication in their possession shall declare it and relinquish it to the gate officer.
Medication shall be identified and stored in a secure area.
If a visitor needs the medication during the visiting period, it may be obtained as directed by the facility.

Small Children

A visitor arriving with a small child will be allowed to take a diaper bag, three (3) diapers and plastic baby bottles into the visiting room, provided all articles are thoroughly searched beforehand. If possible, a suitable area within the perimeter of the visiting room should be provided for the changing of diapers.

When bringing a child that is not your own:

you need a notarized letter from the mother of the child giving you permission, and a birth certificate for the child...

YOU CANNOT VISIT WITHOUT A BIRTH CERTIFICATE FOR NEWBORNS

Bringing your baby on a visit:
when visiting with a baby, you can bring diapers, wipes and a carrier that will be scanned, and pre-made plastic milk bottles. :) they will give you a paper bag to place them in. some may count what you bring in.

How old to visit without an adult?

You must be 18 or older to visit or you must have an adult with you and a notarized letter of permission from your legal quardian if the adult you are with is not that person.

Also make sure that you CC: the facility superintendent and his counselor and also make sure that one is put in his folder for future reference.

Common question:
How do we go about getting him transferred to a facility closer to me, and possibly a facility that has trailer visits?

You have a couple of ways to approach it. Not sure how helpful his counselor is, but that is a source to look at. I am not sure whether they even consider the frp as a reason to move, so you may want to investiagte the locations with frp's and their programs available. One way to get transferred is through programming or lack of them at the facility where he is. You can also call Classification & Movement in Albany and talk to woman in charge there. What if he does not want to Transfer?
I am not sure he has a choice where he wants to go, sometimes they just move you if they think it is best to move you, and if they have a bed, and if they need his bed for someone else....

He might be asked which he would prefer to transfer to, but most times, if the status is changed, and they have space for him, he will move. Depending that he is not getting tickets, and is not fighting, or getting box time, this takes away good time and will impact status.

Leaving Money in a MED or MAX Visit:

You have to put the money in an envelope they give you BEFORE the visit. You have to seal the money (or check or money order) and place it in a box. The inmate gets the receipt the next Monday.

Does anyone know the process to get your name changed after you get married?

Social Security first -then license...and then whatever you want to, like the bank, credit cards,utility bills, work id....Just bring your marriage certificate and old id and it should be changed ok.

You cannot have two ids with two last names if your SS card and license say one. You will be known legally as one name and then if you want too, you can use the other for personal things.

I changed mine everywhere, I kept my old ID only for awhile to show people I had changed my name in case they asked. But I never need it now.

If someone owes a court fine, can they take all the money we send or do they take half?

When you send money in- if they owe a fine they will take half of whatever is sent in.......(deb)

Some have an agreement where they will take money from the Commissary Account every first of the month until the fine is paid.......(julie)

To Mail a Package:

You have to deliver it to your husbands address which is a BOX # and or even his cell # (but not necc.) then add his Din# and the address for the facility -
He has a box # and many places will deliver to prisons!

For Example:

Imates Name and Din# (you can get the Din# by inmate look up on DOCS http://nysdocslookup.docs.state.ny.us/kinqw00)
Box 500 (his box number should be different, my husbands facility #is 750 but he is #700, you need to know,maybe it is the same, my husband is not in Elmira)

For a wedding band: you are not allowed designs. And there is a certain amount you are allowed to spend.

If not a wedding band then only religious jewelry (which they enter in as property)

A brief overview of sentencing terms:

There are 4 types of sentences in New York; determinate, indeterminate, definite and intermittent. (Split is really a hybrid, see below)

Determinate: This is what is referred as "flat." The sentenced is fixed in amount of years (must be more than one) and usually in 1/2 year incredments. This sentence is for first time violent felons (Jenna's Law) and certain repeat offenders. It contains a conditional release date of 6/7ths and must have a Post Release Supervision sentence (Parole after you finish your sentence).

Indeterminate: This is what is erroneously called a "split" sentence. It contains a minimum and maximum sentence. The minimum is normally the parole eligibility date and the maximum is the date of maximum release. Conditional release is figured at 2/3rds of the maximum sentence. First time non-violent felons have their minimums fixed at 1/3 of their maximum; e.g. 1 to 3, 2 to 6. Repeat offenders get 1/2 of their maximums; e.g. 1 to 2, 2 to 4.

Definite: These are sentences served in county facilities or Rikers (one year or less). If combined with a sentence of progation is it called a split sentence. Conditional release is at 2/3 of the sentence. (1 year or "bullet" has a CR at 8 months.

Intermittent: Sentence served in county faciities or Rikers on different days of the week (e.g. weekends). CR is 2/3 of the total time. This sentence is rare and is given for DWI convictions where the judge doesn't want the defendant to lose his job.

I was able to file out for the BC with a copy of his ID - In order to get the birthcert. he needs to send a copy of his ID if possible with a letter to give you permission to get his BC and the BC is mailed out to you the cost is $15.

All copies of certified birth certificates can be obtained through the state inwhich he was born. The cost varies by state. Many times you can go to the county records and obtain. If not most states house certified copies within their vital stastics office; usually linked throught the health department.

How does one report prisoner abuse?

Write a complaint to the Superintendent and Deputy Supintendent at the facility where he is located making them awae of the incident. Copy the letter to Commissioner Goord, and the folllowing places:

How much time do Offenders REALLY serve?
Offenders with FLAT bids must serve at least 85% of the total BID which is 6/7 of the time (for example: 3 years...will serve at about 30 months) Keep in mind, if they have a flat bid, they will not be paroled, but they can be discharged by Conditional Release

Offenders without a FLAT bid (for example: 12.5-25 years) must serve at least 66% of the total BID which is 2/3 of the time (in this example, 66% x 25 = 16.5 years) Unless the Offender is Paroled sooner.

In NYS Offenders with a VO have a hard time getting paroled.
