My husband was sent to county awaiting a comittee meeting with his parole. A friend of his took another friend to my husbands apartment and this guy was being followed by the police and ofcourse busted him in my husbands apartment. Now he is being charged by his p.O. with gang association. Does anyone know how much time can the borad give him for this???

Can't give you an exact amount of time, but usually a typical parole violation is up to 12 months minus whatever time he's already doing in county. So, anywhere from 4 to 10 months if he has no new charges.

Non-association clauses require sufficient notification to be enforceable. For instance, if the gang member wasn't identified by your husband as such, there wouldn't be a parole violation. CA parolees have a right to counsel these days.
A standard run of the mill parole violation seeems to be 10 months with half time. Technical violations can get less. Knowingly hanging out with a wanted bad guy wouldn't usually be a technical violation.

The max is 12 months flat time. Your husband is gonna have to be VERY careful in the future, because after this they will most likely really watch him for "associations". I doubt they'll give him very long for this one, since he couldn't control who showed up, unless he knowingly let him stay of course. And his county time all counts.

he should be interviewed within the first 30 days and make him an offer, he can pleasd not guilty and go in front of the board, which is what my husband did. they offered him a year, he turned it down , went in front of th eboard and was released that night. I think alot of his had to do with his work wrote letters of how good he was doing and so on. so if he was doing good he may hava a chance. My husband was in custody a total of 36 days so it's just a waiting period.

My husband says they almost always offer a year, which is the most they can give you. He says you might as well turn that down, since the Board can only give you the same, or less. He has ALWAYS gotten less time from the Board than the offer. (And it's been a FEW times>>>>) But don't count on that short a time period. We've never been to Board in less than 90 days, no matter what the rules say.

he goes tomorrow. the parole attorney just called me to see if i was going. i knew nothing about it so good thing he called. they offered him 12 months twice and he said no. the attorney said from 10 to 12 months but no less than 10 months. just glad it's going by fast. got busted 12/27. went to court sent to chino 2 days later on a friday saw comittee that monday ( last week) and now board. so not bad all that in 1 month. thanks for your help

dang, that was pretty quick. my man was picked up on violation 1/6, and just went to board last week, and they offered him 8 months. that's what his PO told me anyway. i got a letter today from him saying 90 days, i month served. which means home for him april4th. im so happy, cause a year is a long time when you're pregnant, with three little girls already!! cubana, i wish you guys luck tomorrow!! hopefully he'll get out soon.
