View Full Version : Help! What is Happening??
baldwinlady 01-12-2006, 03:39 PM :angry: Oh lord, I don't know what's happening. Ok, let me start at the beginning, as most of you know Jason was "recommended" by the Judge to go to the TC program at St. Clair, when he got to kilby they changed the ruling and "ordered" him to the TC program at Ventress, so then Jason went to Ventress and refused the TC program and signed up for SAPP. After several mths with not being put in any program, i called Mr. Marshburn (the man in charge of the drug programs at Ventress) he told me in order for Jason to qualify into any other program the Judge would have to amend his ruling and sugguested a Dual Diagnosis prgram (4mths) that seemed to suit Jason's needs since he does a mental issues to address. So right after Huricane Katrina, I wrote the Judge and ask him to amend his ruling so that Jason could get the proper help he needs. That was in September, I called the clerk's office today and she told me Jason's filed was finally sent back and there was a transportation order to have him sent back to Baldwin county on 2/23/06 for a review of his sentence. What the FFFFFFF!!! Jason EOS date is 4/19/06, I then called and spoke to Mr. Marshburn again, he told me a few things could happen. the Judge could review Jason file and release him on 2/23 (which he didn't think so since judge don't like it when the prisoners doesn't do what they told him to do) but since may be possible since the prisons are so overcrowed and Jason has not been in any trouble. OR leave him sit until his EOS (and probally serve the remaining 2mths in County, OR he could change the order and make Jason go back and enter into the Dual Diagnosis program OR make Jason serve the remainder of his 5 yr sentence. I DON"T KNOW WHAT"S HAPPENING OR WHAT TO DO!!! For those of you who know the story, I had Jason revoked, I begged the court to help me save my son's life, and as of April/06 it will have been 16 mths he has just sat not getting any help, not on his med's, and know after Katrina I need my son home and I really feel he has changed his ways. I know I need to call the Judge clerk (which i know) and she knows the situation, but what do I say, or do I even call. WHY IS THIS HAPPENING?:angry: I'M SO SORRY TO DUMP THIS ALL ON YOU GUYS, BUT HELP GUIDE ME IN THE RIGHT DIRECTION PLEASE.

Blueyez94 01-13-2006, 10:17 AM I would start with the Judges clerk to see what she thinks...I would hope the judge won't make Jason serve 5 yrs. Hopefully the judge will see that Jason is trying to do better by trying to take SAPP. Hopefully the judge will let him EOS (or maybe let him go on 2/23) and suggest him going thru some programs out here.
DeniseJ 01-13-2006, 12:56 PM oh, linda..just when we thought things were going good..ok, to be honest..this is not good at all. for one the judge is not going to be happy at all about jason refusing TC program.
Is there anything in his file to prove that he's made an effort "improve" and/or "rebilatate" (sp?) if not he better get his but in gear before 2/23, he needs something, anything showing aleast some effort on his part..
the thing is Linda, Jason know these things, he's been told by not only you but i'm 100% sure there's inmates around him going thur the same thing....
go ahead and visit/call the judge and/or clerk and find out why this is coming up, be prepared to have a "plan" for release or re-sentencing...it could be that due to the overcrowding issue that the "review" of parolee's that have been revolked due to tech violations are being sent to community corrections instead of prison may be the reason for this...
this is so un-predictable..and scary..lady you and jason are both in my prayers...

baldwinlady 01-13-2006, 03:51 PM Yeah your right, just when everything was getting better! And your right it's not good at all. I called the Judge's clerk, she told me this had nothing to do with my letter I sent in, she said they got a note from the Parole board (I guess from when Jason went up for parole in Oct/05 & denied) that Jason had refused the TC Program & the Judge told her to have Jason picked up for a review hearing. I asked her what was going to happen, she was a real "B" and said whatever the Judge wants. Damn it, so I called Mr. Marshburn back and he told me Jason should have copies of the request he turned in for other programs and if not Jason could request them. He felt very bad but did say he felt the worse case would be that he send Jason to the Dual Diagnois for 4 mths. He didn't think any worse because of the overcrowding/his first time in prison/and has not got in any trouble. But he doesn't know this Judge, depending on the day/his mood. He's the Judge that if one is guilty, then everyone is guilty. I know hiring an attorney would do no good, it's all in the hands of the Judge!! A judge who could care less if they hang the prisoners on a nail & put them handing from the walls. And I know he will be pissed. I guess all I can do is pray, and go in with all the past mental eval's. I wish I had something to show the Judge what they do in the TC program to the prisoners so he would understand that a person with mental issues as well as drug, can't hang in that program. Couldn't Jason ask to be sent to a half way house or something? any idea's would be so greatly appreciated. God I am so scared, and boy Sunday sure won't be a good day, I have to tell Jason. I haven't even told his Grandmother yet, she is so excited she been counting day's to, yesterday she said we need to start hitting the after holiday sales and buy clothes for Jason since his ex-wife got them all since we only have 95 days until he's home. I'm not trying to have a pitty party, and I know I'm a very strong woman, BUT WHY SO, SO, SO MANY TESTS?
If any of you can think of any ideas/thougts to help I would appreciate it, Im a nervous wreak (AGAIN) and I know I'm not thinking clearly. Or maybe I just don't want to face the fact there not a damn thing I can do. And finally thanks to all of you for listening and for being here for me.

O'reilly 01-13-2006, 04:09 PM Could this Mr. Marshburn write a letter explaining what type of programs that they have to offer that would best help Jason, perhaps even mentioning the TC program won't be suitable for him? And if he knows your son, perhaps remarks on some of the positive things he has been doing as well.
baldwinlady 01-16-2006, 04:30 PM ok, I broke Jason's heart last night when he called. Boy was he in shock. But he had some good points, that made me stop and think. When he first got in trouble he was charged with theft 1st & theft 2nd. He served 9 mths in county and then sentenced to 5 yrs/split time served & given 2 yrs probation. After being on probation a yr he started messing up and to make a long story short (cause most know) he was revoked. Now this is what the order says "IT IS ORDERED THAT THE DEFENENT IS COMMITTED TO THE CUSTODY OF THE DIR OF THE AL DEPT. OF CORR. TO SERVE THE BALANCE OF HIS ORIGINAL 5 YR SENTENCE. THE CORT HEREBY "RECOMMENDS"THAT THE DEFENDENT C OMPLET THE PROGRAM AT THE THERAPEUTIC COMMUNITY CENTER AT ST. CLAIR. DEFENDANT WAS ADVISED THAT THE HAS THE RIGHT TO APPEAL THIS CONVICTION AND SENTENCE. Then when he got to kilby they chaged the order from "Recommend" to "Ordered" and Jason refused the program, and choose to EOS his sentence. Ok, so how can the Judge change his own ruling and make Jason do more time than his EOS date. The Judge can't take away good time, only ADOC can Right? I'm confused, I know the Judge is going to be pissed but I can't for the life of me understand him being able to change his EOS date of 4/19/06. I have a copy of the Alabama cheat sheet and it show 5 yrs you serve 1 yr and 9 mths and 13 days. He has been in since 12/17/04, he served his time. Good Lord, I need some guidance, I can't afford an attorney, not that it would do any good anyway. It's just seems like the Judge must follow some king of F'ing rules. And the most I can see him being able to do, is either let Jason ride out his time in Baldwin county for about 2 mths, or send him to a program or half way house for that same amount of time. I'm I crazy or can Alabama really do whatever the hell they want to do. Jason is still under quarantine and can't get out to speak with anyone to help him, he doesn't have copies of his request in turned in to get into other SAPP programs. Tomorrow I'm going to call Ventress again and speak to the Warden/Chaplain and Mr. Washburn. Even though he's in quarantine he's got to be allow to prepare for this hearing. He needs copies of his request, letters from somebody to show he has been trying. I don't even know how long Baldwin County will go get him. Maybe I should have posted under "prison legal help". Any thoughts out there, I could really use some advise, cause right now I feel like I'm losing my mind. Thanks to all of you for letting me vent and for all the support.

DeniseJ 01-17-2006, 08:27 AM linda, what a mess...do you have a copy of his time sheet? there should be a Short time and Long time on it.
I'm not sure when a Judge looses jurstriction over an inmate, any chance there's some new charges out there that you guys are not aware of?
one thing is for sure its out of your control, Linda, YOU have done all that could be done. you son is very lucky to have you, and as far as we know this could turn out to be a good thing, I just can't see them ADDING to his sentence. The only thing you can do is be at the hearing.
The judge is going to want to know what Jason has done, not what you have done. Keep that in mind as you both prepare yourselfs for that day.
the case worker/classification officer will have all of his records and chances are a copy of everything will be in his Jacket.

I know nothing about your situation, but I do know this, Christ Jesus does not throw away his children and he does not turn a deaf ear to those who with a broken heart and humbles themselves before him. If you will give it over to God and believe and not try to handle the problem yourself but give it to God and let the Master do what he does best, change lives!!!!!
