Hi, I am pretty much new to this whole military confinement. My Fiance was just put into the Miramar Brig in November and while he has been sentanced I am just unsure how this system works.

He was told he was supposed to get a 1/3 of his pay since that was one of the conditions to the agreement he made with the prosecution and has not recieved anything since his confinement began. And how do you find out when they have those "monday" holiday visits. Is there a schedule posted somewhere or is there someone you are supposed to call? I always overhear people talking about upcoming dates and I was wondering if there was a placed that listed them or something.

Sorry i dont know about the special visit, but i did want to say welcome to pto, its a great site, there is lots of support here if you need it.

as far as the pay issue, i would contact his military attorney, who is still assigned to him, until he gets his record of trial, then he will get a new appeals military attorney. let him know that he is not receiving any pay. you could also try going to or calling the finance office at the brig? dont give up! good luck

First, welcome to the Forum. Second, I'm not nearly familiar enough with the pay issues of incarcerated military members as I'd like to be, but wanted to say that your fiance needs to contact his JAG, his command and Finance on the pay issue. Unless the military has changed drastically, you probably won't be able to get anything done since you are not married. Although this could be an issue to raise on appeal, it certainly isn't an issue you want to wait years to have resolved! Don't wait, tell your fiance to keep after them and keep contacting whoever he can think of to get someone moving on it. If you have to, contact your Congressman--I have and it worked! My family is still receiving pay as authorized by the conveining authority. HOWEVER, be careful, we arent getting his regular pay since he is being charged housing and rations allowances, dental insurance, ect. So, your fiance's 1/3 may include any deductions, which, depending on his rank and time in service, may be nothing. *Definately contact the defense counsel where he was prosecuted. Make sure he has in his possession a copy of the sentencing that allows the pay. *Have him access, or give you access to his pay account on MyPAY (the militarys online paysystem) There you could pull up his previous and recent LESs (leave and earnings statement) and see if there has been pay, and if so where its going. their site is at

Also, you can print out his W-2 from MyPay, the W-2s should be available by 15January on this site.

Sounds like your husband will be returning to duty, right?
They may be waiting for the conveneing authority to approve the sentance. I know more about general courts martials and discharges and am kind of guessing about return to duty type sentencing proceedures.

no he is being discharged after he completes his sentance....I feel like they are railroading him because the other people involved in his case with more severe charges are still out and about walking the streets and they are also military!

Hunter, that is a frustrating situation. Unfortunately, criminal justice systems (military included), don't produce the common notion of "justice" iin a lot of cases--especially when plea agreements are involved. It sounds like your fiance's plea, unless modified by the convening authority or some other superceding authority, will be the contract between he and the government. Whether or not the agreement was ultimately "fair" in comparison to the disposition of other defendants' cases is immaterial--as long as he knowingly, intelligently and voluntarily agreed to the terms of the agreement. Sometimes, with hindsight, the deal isn't as advantageous as it seemed, but it's a done deal unless it contains a glaring error of law. Please follow through on the suggestions on this thread about who to contact to find out more information about your fiance's rights, and yours too! The military bureaucracy defined "red tape" years ago, so just keep after SOMEBODY or many somebodies until you find what you need to know. If I see anything in my reading that might help you, I will let you know. Good Luck and hang in there.

Its hard for me to keep on it and bitch when they are not complying to the deal. I called once and they took away his phone and visitation priviledges until he gets out. He is trying to appeal it but basically I have to sit by and watch them railroad my fiance when the guys that should be in jail are walking free living their lives...its so damn frustrating
