I have never been in one before so do not know how it all works,I know how I think it SHOULD work but that isn't the case for me.It was zero percent my fault I got rearended,have witnesses,the whole nine yatds.

My insurance co. sucks basically! They are slow as heck and not of much help.I am now w/o a car at all as mine hasn't even been looked at yet and I can't afford a rental as I already paid out of pocket for a tow and a weeks rental car. Yes they are getting dropped as soon as this is over :angry: and I may even go for an accident attorney depending on what happens today when I call the ladies ins. co myself (something my insurance said they would handle but so far have not I guess?) I am waiting for a call back from my slacker comp. now after various nasty messages by me and a promise of a call back this afternoon

Anyways my question is do I have to file a report with the DMV? I believe I do if the damage is over $750 BUT I have no clue how much the damage is yet as again my appraiser hasn't bothered to show up or call which he was supposed to do Thursday ) I do believe it will be well over that amount though).Do I file the report now or wait until I know the damages? My concern is I *thought* you only had 10 days to file the report and today is the 10th day

I would file a report with DMV. That way your side of the street is all clear. lol I wish you luck with this one! I've had a couple of accidents and the insurance company's are always a big pain in the behind!

When our insurance agent didn't do his job after my husband's accident, he made a call to another office and asked for the district manager. After his call to that person, our agent suddenly became very efficient!! They ended up paying for 60 days worth of rental (we borrowed a car from my dad) and wrote off our deductible.

Get the number of the district manager. Lie if you have to...make some excuse.
Try to avoid going to an attorney, they take a minimum of 33%. Those of us here know how to be pushy and when you're dealing with insurance agents, ya just gotta be!

The person that rear ended you has insurance, right. Then that insurance company should rent you a car. That's what happened to me. Let them pay!!
I don't know which insurance co. you have but I have 21st century and let me tell you they kick butt. My car got fixed real fast and everything. Give them a try. They aren't that much more expensive but the service is great.
The DMV thing you might end up with a point? But if you switch to 21st century (no I don't work for them) they have a no fault thing where your insurance premium wont go up if it wasn't your fault.

p.s. if the insurance co. don't return your call, get the operator and demand a supervisor of that department. then they will get to you right away. my lawyer friend gave me that advice long ago and it works.

I was in two car accidents one in dec 2004 the other in aug 2005 BOTH WERE 100% not my fault I filed a report with both. Just to be safe so that no one would come back at me and say I didnt report it in a timely matter. Then I found out from my insurance they took care of it all just about the same day I did for both LOL. So since your insurance slacks I would make sure to get inthere and do it. Better be safe than sorry

I know NOTHING about California insurance, but I do work for State Farm in Mississippi and I'm sure WHO pays for what is the same from state to state.

If you are NOT at fault in an accident, the person at fault's insurance company is the one that pays for the repairs, towing, and rental car fees. Your insurance company would only pay in the event that the person at fault does NOT have liability coverage (or not ENOUGH liability coverage) to cover the damages.

Good luck to you!! Even though I work in the insurance business, I do know that it's NOT fun dealing with them!!

Well I sent in the form to DMV,filed a claim with her insurance co. but I have a feeling her policy has lapsed as they said they have to investigate her policy first as there may be an issue with it.They were a lot more pleasant and quicker as far as assigning me a claim # and an adjuster then mine was.The crazy thing is my insurance company could of located her and done all this 10 days ago as it only took me 5 minutes to do it myself! Ahhhhhhhh! STRESS!!! Her insurance co. is supposed to call me back tomorrow at the latest in the meantime I am going to get an estimate as the appraiser from my insurance co. was supposed to be out here LAST THURSDAY but never showed and no one is returning my calls!! and I still have no freaking car as a rental hasn't been authorized yet!!!
