View Full Version : Emergency Powers Act (EPA) Information butchies_girl 11-06-2005, 12:03 PM Does Any One Know Yet If And When The Epa Will Kick In Again? peaches030761 11-06-2005, 08:57 PM My fiancee was just telling me that he heard there should be a "year end" EPA kickout. ros/lo 11-09-2005, 10:38 AM I heard that the expanded epa was going to kick in. I was told jackets went up Nov.4th. Does anyone know anything about this or may have heard anything? (The yearly) EPA Ros/Lo crisnclay 11-09-2005, 05:59 PM hey ros/lo.. i havent heard anything but i will ask butchies_girl 11-09-2005, 09:38 PM Who Qualifies For This ? And How Will We Know If Our Loved Ones Are Up For It? Tommy's girl 11-11-2005, 11:37 PM Forgive me for asking...but what is EPA? I'm afraid that I'm still new at this and don't know. Thanks for the info.. Tommy's girl Jade01 11-13-2005, 07:00 PM Here is a thread describing exactly what EPA is and some links to find out information about it. http://prisontalk.com/forums/showthread.php?t=147717&highlight=EPA FinallyFree 11-14-2005, 06:43 PM The EPA will kick in on the last day of November and will start releasing people withing a few days thereafter. This is the 90 day EPA. They start with people that have already went to the board and made it also people that will be flat in the next 90 days are included in the first batch because this is less work for them. After these two groups have been exhausted then people whose home plans are not back but have been to the board and finally people who have yet to be to see the parole board! On the 1 year epa it should kick in whenever the county jail backlog exceeds 500 but that does not happen. The county jail backlog has been around 600 for the past two weeks. You must realize that this is all politics and they do things when it is easy for them. You can check the county jail backlog bu going to Arkansas.gov and doing an inmate search. Add up all inmates currently on the waiting list at each county. FinallyFree 11-14-2005, 06:59 PM Usually the people who qualify for these things are non-violent offenders. The 90 day EPA even 70% people qualify. The one year only non 70% non-violent offenders qualify. crisnclay 11-17-2005, 06:35 PM I just talked to my husband and the 1 year EPA kicks in next month as well as the Christmas kick out Jade01 11-17-2005, 11:19 PM Wow, thanks for the info Cris! (Keeping my fingers crossed, but not getting my hopes up) Jade01 11-21-2005, 02:16 PM Crisnclay - I wanted to find out more info about the 1 year EPA act and actually called ADC general information. They said that the 1 year EPA kickout is NOT being considered right now and there is no talk of considering it in the near future. The last 1 year EPA kickout was November of last year, but as of yet, it doesn't look like it's going to happen anytime soon. They said it all depends on the backlog - haven't actually checked to see how much it exceeds myself - so who knows. crisnclay 11-21-2005, 05:37 PM Hunts, i sent you a PM butchies_girl 11-23-2005, 06:43 PM well my hubby is a non violent offender but i dont think he qualifies for it yet love-austin 11-29-2005, 11:27 AM I called yesterday and was told that they are going to vote on the 90 day EPA today. Does anyone know how long (after it goes into effect) does it take for them to start releasing them? FinallyFree 11-29-2005, 12:09 PM Ususally within seven days. It will be quicker if they already have an approved home plan! ros/lo 12-12-2005, 03:10 PM Have you heard anything else about the 1 year kick out???????? crisnclay 12-12-2005, 05:28 PM ros/lo - I am going to send you a PM jenjen43 12-16-2005, 05:04 PM my husband has been in for a yr as of feb. and he didnt get 70% he is non violent offender so what does that mean for him? will he be able to get it or might he?:) Jade01 12-18-2005, 07:30 PM Jenjen43 - It sounds like your husband is eligible for EPA. karri lewis 02-27-2006, 08:00 AM i talked to the parole lady at pine bluff and she said they are voting on a 90 day EPA on march 15th butchies_girl 02-27-2006, 02:39 PM do they have to be a certain class to qualify for the EPA? butchies_girl 03-17-2006, 06:30 PM Arkansas News Bureau LITTLE ROCK - The state Board of Corrections invoked the Emergency Powers Act on Tuesday, making up to 633 prisoners eligible for early parole hearings. http://www.arkansasnews.com/archive/2006/03/01/News/334566.html Jade01 03-17-2006, 07:44 PM Thanks for the info butchies_girl! leslies_princes 04-08-2006, 10:11 PM My husband is at Brickeys (East Arkansas Regional Unit) and is there on a kidnapping charge and his t.e. date is Jan 5,2009. He has the 70% charge or whatever it's called on him....will he be able to do the epa thing or what because this is his 1st charge and only thing on his record? Jade01 04-09-2006, 07:08 PM leslies_princes - Your husband is not eligible for the EPA due to the 70% and I don't know if kidnapping is considered a violent charge or not but violent offenders are also not eligible. Here is a link with information about the EPA: http://www.state.ar.us/doc/adcar_pdf/AR1316.pdf Mark's_Girl06 04-29-2006, 09:13 PM do you think that my husband might qualify for the EPA his PE/TE date is Nov 2007? That only if he doesn't go to boot camp. his charge is a non-violent crime. He went in March 2006. I download the EPA document of it's web site. butchies_girl 04-29-2006, 09:19 PM prolly marks andrea76 05-09-2006, 10:41 PM my boyfriend went in in march of 2006 and his te/pe date in 06/10/2007, he is a class 1 and non violent charge, would he qulify?? and did yall say the next one was coming up in Nov?? Jade01 05-10-2006, 12:28 PM andrea76 - sounds like he should qualify I don't know when the next EPA kickout is but unless it is the 1 year kickout (which doesn't come around very often), he will have to be within 90 days of his te/pe date. karen3693 05-10-2006, 11:34 PM From what I understand there should be another EPA in June karri lewis 05-11-2006, 05:20 PM my husband just told me that there was one on the 27th or 28th of this month karen3693 05-11-2006, 05:52 PM That sounds about right.I have been told May and I was told June it depends on who you talk to.Will your husband be released early? Sierra 05-13-2006, 06:44 PM For the EPA in May or June, how long do they already have to be in and how close do they have to be to their parole eligibility date? Each facility already has there list and if there home parole plan has been approved they will probably be released within a week. My husband is scheduled to be home before next Friday. His te date is 8-22-06 he went before the board on April 26th. And believe it or not the guy that conducted the hearing actullay told us that day that he was recommending to the board he be released. So good luck to anyone else that's waiting to hear something.......... butchies_girl 06-01-2006, 12:47 PM man come on hope it kicks back in before xmas butchies_girl 06-01-2006, 12:55 PM i know he makes class this week will that include him tho never mind butchies_girl 06-01-2006, 12:58 PM but congrats ros/lo on your homecoming ittybittykitty 06-01-2006, 03:00 PM Best of Luck to you ros/lo and family:) It is exciting to hear some are getting to go home.Kitty Jade01 06-01-2006, 03:14 PM Glad to hear the good news ros/lo! Congrats and best wishes!! karen3693 06-01-2006, 04:08 PM I am glad to hear that someone is coming home.Butchies_girl there should be another EPA in Sept.According to what I read the EPA has kicked in every 90 days since 1998. butchies_girl 06-01-2006, 04:22 PM ty karen im just soooooooooo ready for adoc to kiss our hind ends karen3693 06-01-2006, 04:36 PM Gosh your quick! I am sooo ready for my son to come home .I know he has not been there long ,but in my opinon 1 week is too long.I have a nephew that is 35 and it looks like he is going to have to do some time.I really cant say anything about him.Saline county has been giving him chances since he was a teenager. His luck has run out.He has done 10 times worse than your husband or my son. They just kept on slapping that hand. Now here he is 35 with a bunch of kids.Thats the sad part. ros/lo 06-02-2006, 08:56 AM In talking with the lady she stated this one will end on August 25th and the next one will start about 2 days after that.... That may answer your question.... It has been a long wait but for the most part it hasn't been really bad he only stayed in Newport for a month and a half and was sent to work release in Tex. which is about 30 miles from where we live and he has had furloughs so he gets to come home once a month and visits every Sunday from 12-4. I think the worst part was Regional Maintance before he went to work release. Keep your head up and continue to trust God..... butchies_girl 06-02-2006, 09:25 AM well as i said hes going up for reclass this week i believe and from that i hope we make it i dont know how that works i just know his time is coming soon butchies_girl 06-02-2006, 12:41 PM well i just got a letter from Frank and in it he told me 15 guys left delta yesterday so congrats if yours was one of them karen3693 06-05-2006, 08:01 PM My son said Sat that a bunch left Varner this week.He was notified the day after I called the unit that he goes before the board June 27.They want to ask him a couple of questios about his crimes butchies_girl 06-05-2006, 08:40 PM well i got good news yesterday Frank was moved to pre release Zfriday so now its a wait game karri lewis 06-06-2006, 12:28 AM my husband was released on june 1st,,i am so glad the epa kicked him out so soon,, rainier 06-06-2006, 09:28 PM CONGRATS to everyone whose loved one has been released! Does anyone know if the EPA kickout in August is a yearly kick out or will it be like this past one? butchies_girl 06-07-2006, 09:28 AM it will be like this one and my hubby is going to make it in time YIPPEE rainier 06-07-2006, 12:58 PM One more question about the EPA. My bf is starting the SATP program which is 90 days or whatever and by that time hopefully they will do another kick out. He will qualify for the next kick out but he still might be towards the end of the program. Will they make him finish it or does it just all depend on if they think he has done well enough already or not? butchies_girl 06-07-2006, 01:09 PM as far as i know he will have to finish it before he can be considered for parole it is a mandatory program karen3693 06-08-2006, 05:22 PM They put my son into that program 2 weeks ago.He goes before the board June 27 his release date is Aug 1.On the Varner info they say it is a 30 day program.I talked with a guy last week I work with his wife they both have been out a year. They were both in for meth. She said she took it twice and anything else that was offered, on the other hand her husband said he was put in it 3 times never completed it was thrown out all 3 times. karen3693 06-08-2006, 05:24 PM I forgot Butchies girl is your husband in Benton at work release there? butchies_girl 06-08-2006, 06:17 PM No Hes In Dermott Now Has Been Since Feb. msfrog 10-04-2006, 07:26 PM Sorry, I know this doesn't belong here, but I did not find a place to ask this question. My son is in Cummins, working the harvest, his boss asked him yesterday if he wanted to go Act 309 (he has turned in his paperwork months ago) to Monticello . Does anyone know anything about that facility?? wolfen 10-20-2006, 04:46 PM I heard from my fiance that the epa was to be in the early part of December. Let's hope so. Skylar's_love 10-24-2006, 05:24 PM Ok the next 90 day kick out with be the end of Nov. As far as the yearly goes....
