View Full Version : Can you transfer an american inmate to a prison in Canada???

Hi!!!
I am hoping someone will be able to give me some information regarding the above topic. My husband is American and serving his sentence in California but I live in Alberta and he has asked me to look into possibly getting him transferred up here for the remainder of his sentence- is this possible?? Please help! I have looked and looked and not found anything, the distance is REALLY hard as I am sure most anyone can relate.....any info would be great...thanks!

i don't think it is allowed unless he is a canadian citizen ,and then maybe, it is a lot of footwork but start by calling ottawa csc headquaters and get as much info as you can

If you are a natural born citizen of the United States, serving time in a US facility, there is zero options available for transfer.

If you have dual citizenship and you are already in US custody there is zero ways to denounce your US citizenship and then transfer.

If however you hold dual citizenship, the US has many prisoner transfer treaties, and States also have international treaties signed. Actual treaties can be found in reference libraries, immigration attornies, Dept. of Justice, Board of Prison Terms, International Embassies, Consul General Offices and probably even Google!

If you are serving a State sentence, you must apply to the Board of Prison Terms in that State, then the US Dept. of Justice, then the country which you want to transfer to.

If you are serving Federal time, it is much easier to transfer, and don't have to deal with any Board of Prisons.

If a sentence is approved, then the day you transfer your American sentence no longer exists, and the sentence is now under the laws, and parole system of the receiving country.

An important note to Canadians, if you have no federal record in Canada, and are a non violent offender, when you arrive back in Canada you will be fast tracked out of the system on you earliest release date (1/6) of your sentence. However, in Canada you only get fast tracked once, if you are every arrested in Canada you will serve alot more time as a second time offender.
