I have read alot of posts about sentence reduction? Are mandatory min. drug charges eligible for these and how do you get it started. PD never brought out questions that we(family) believe would have reduced the actual charges brought to lesser charges.

Is this state or federal you are referring too ? Is he in a fed institute or state ?

Minimum mandatories are exactly that- they are not eligble for one day of good time. parole or sentence reduction. They have been deemed legal and just by the supreme court. The only time there might be an exception was that a judge ran his sentences consecutively (or stacked) and he did not have any priors. There was a supreme court decision about a year ago that found this unlawful. My husband is doing time under a minimum mandatory law and I've done quite a bit of research on it. Sucks doesn't it?

I am posting an email that I just recieved from Families Against Minimum Mandatories. I know this is an old forum, but hopefully will be able to reach anyone that cares about this subject to easily send support for this bill that was just introduced March 12, 2009.

Federal sentencing bills that FAMM is following are below.

H.R. 1466, the Major Drug Trafficking Prosecution Act of 2009
On March 12, Congresswoman Maxine Waters (D-Calif.) introduced H.R. 1466, the “Major Drug Trafficking Prosecution Act of 2009.’’ The bill would eliminate all mandatory minimum sentences for drug offenses; curb federal prosecutions of low-level drug offenders; and allow courts to place offenders on probation or suspend their sentence.

In a speech to Congress, Rep. Waters cited “Correcting Course: Lessons from the 1970 Repeal of Mandatory Minimums,” FAMM’s 2008 report on how Congress first enacted mandatory drug sentences in the 1950s, then repealed them 20 years later because they failed to reduce drug trafficking.

Thank you for this info. I am new to all of this. But I have a major battle ahead of me, my brother was sentenced to 15 years for manufacturing marijuana! This was Federal time in Michigan. It will be appealed but I am going to do alot of research and contacting of important people. This is only day one. Any more info that you have on this kind of unjustice would be greatly appreciated.

hello every one i have posted trough out this website, in different posts asking for information on this subject.
my husband has been incarcerated since 05 and was given a mandatory minimum sentence of 30 to serve 25 and the rest 5 years on parrole. he doesnt have any prior convictions and im hoping this law also applyies to the sate of GA. FROM all the reseach iv also done i think its a great thing to do. it was about time!!! but i still need more info. please send me an IM IF ANYONE KNOWS ANYTHING MORE ON THE SUBJECT. GOD BLESS.
