My pp on DR has a borderline IQ. He seems rather normal as far as I can tell and has a college ed. He has a bad school record of class disruptions and short attention span. Aparently he has memory problems which I have to say are apparent in his letters (little things like: he forgets I thanked him for a poem etc and asks why I didnt mention it). Now the state did a PET scan the result of which showed 'a very severe level of abnormality to his frontal lobe'....

I wonder if this would cut it though? Could a person get life rather than DR because of brain damage? Any thoughts on it?

I have to say I personally am skeptical.

I have been told that a persons sentence can be reduced if they find that person IQ to be low enough that he may not be "at the right mental capacity". I have heard this before. Alot of guys in prison facing these type sentences have these test done and the lawyer argues the fact of mental evaluation being relavent in their case.

He needs to get an MRI done on his brain. You need to know abt "the very severe level of abnormality" like where it came from, is it life threatening or not, etc.
