My son's sentence was a 20 split 3 conviction. for A class a felony 1. I have had many people say that he would more than likely not serve the full three years. But, others said that its three years day for day so I am confused:o . Who makes these decisions to release them? And if any of you can shed a little light on this from experience , I sure would appreciate it.

Hi, Angie. If your son received a 20 split 3 sentence then he will have to do the whole three years..day for day. I know that may seem hard...three years....but it is so much better than getting the straight twenty! My son is finishing up his sentence this month...and believe it or not...the time did seem to go by fast for me...but maybe not for him.

As far as I know he will have to do the whole 3 years, especially on a class A felony....but be very thankful that they took the deal because my boyfriend was offered a 10 split 3 and he didn't take it so know he has a 15 year sentece with a CHANCE to come up for parole in 5 years..be thankful..And welcome to PTO

My baby says it's day for day on a split. Like a buddy of his got 20 split 5 for something, and he has his release date already and it's exactly 5 years from the day they picked him up. I hope this helps.

yes, he will ahve to do 3 years.Be thankful, my husband has a 20 year sentece with a 5 year mandatory,he has done 4 years 8 months of it as soon as he does his 5 years he can come up for parole,but whether they release him is a different story.

my son had a 3 year sentence and after 1 year is up for parole the second time. In fact his hearing is on monday. He has another case that he has accepted a plea agreement for a split of 3 years probation. Does anyone know how that works? We are just waiting on a court date for the second one, the plea has already been accepted and waiting for the judge to set the date.

I hate to say it, but with a split sentence he will have to do the 3 years day for day. That means he doesn't get good time or come up for early release (unless a miracle happens). My husband got a 15 split 2 and he has to do every day of the 2 years, which means he gets released on April 23, 2007. After that he has 2 years probation, during which if he gets into trouble he will have to go and do the rest of the 15 years(if I am not mistaken). The only time he can get credited for is if he has served any time on the sentence that got him the split deal, say in the county when he got arrested on that charge. No other time served for any other charge counts toward early release on the split conviction.
