View Full Version : Being Transferred to Georgia

Hi,
My husband is serving time here in Delaware (15 years so far of 67) and he was sentenced to life in Georgia in 1994 for a crime he committed when he was 16 & confessed to when he was 24. Once he gets paroled here, which could be several years, he'll be extradited to Georgia & that's all we know. No one within the GA DOC or anywhere has been able to give me any information because they say "his file is inactive". He's received only 2 letters - one from the DOC & one from PAP, with conflicting information: one says the sentences (GA & DE) are concurrent & one says they're consecutive. Obviously there's a huge difference. I can't get anyone to confirm which one is accurate. The attorney who was his public defender at the time is nowhere to be found and has been suspended from the GA Bar. We're getting nowhere. We have no idea where he'll be tried or housed or what their parole/sent. mod. process is like, and we've made dozens of requests for his records/discovery material and still have nothing. Any advice or information would be greatly appreciated!

I dont know if this helps but if I were you, I would hire a local attorney in the county he was convicted in, explain the situation and ask them to go to the sentancing judge for an amendment showing the sentances are running concurrent.
My husband also had two convictions and intially he was not given the time already served so his attorney contacted the judge for an amendement to get things running together.

OR have your husband and your family members write to the sentancing judge to ask if this is running concurrent/consecutive and if its not running concurrent to please set it so.

You could start by writing the judge that sentanced him and if you get no response, I would then hire an attorney.
The DOC here is very tough to deal with on your own. They give you NO information before they decide they want to. The DOC may be correct by stating that the files are in an "inactive" status because they wont make his file active until about 30 days prior to your husband's parole date to set up the extraditon papers.
It would be in your best interest to eventually talk to an attorney to find out if any of this could be counted towards his time in Georgia.
