WOW!

I just posted the new parole laws in our lifer resources forum, saying the new rules would help lawyers... well, here is the first major victory folks!!!

The appeals court held that a governor's veto must provide specific evidence showing WHY someone is not safe and should not be paroled -- just saying the original crime was terrible is no longer enough.

PS: Those of you in other states, take heart; like they say -- as goes California, so goes the nation. At least on prison matters. For once it's good news.

Appeals court orders release of county parolee
STAFF AND WIRE REPORTS

SAN FRANCISCO — A state appeals court Tuesday set aside a decision by Gov. Arnold Schwarzenegger and ordered the parole release of a San Mateo County man convicted of a 1986 murder.

George Scott, 65, was sentenced in San Mateo County Superior Court to 17 years to life in prison for the shooting death of Douglas Bradford, who was his wife's drug dealer and lover, on July 4, 1986.

Last year, the state Board of Prison Terms found Scott suitable for parole and said his release date should have been Oct. 4, 2001 — three years earlier.

Ohh qwerty! This is great news!!!!
Ironically, I was feeling so down in the dumps because I just received an email notification from the Appellate court that my husband's writ was denied and now I received this good news from you and my group that this has happened. If will give us a better chance after a parole date, to let the date stand!!!!
Yippie!!

Question, shouldn't this apply to the parole board as well????

You're reading my mind... the criteria are the same for the board and the gov.

Aw hun, I am so sorry about the writ... but this shows, never give up!! (((hugs)))

we kind of knew it would be denied, his attorney was prepared to take to the federal level anyway but my husband also goes in front of the board hopefully in the beginning of next year. As you know the parole hearings are so backed up.

You know, I heard recently that the board could state "the nature of the crime" to deny a date. I hope that this reaches to the the parole voard as well. I know the parole board denied my husband based upon the "nature of the crime" twice.
Anyway, this is great news, I'm very happy about this!!!

the new on the lifers is fine. I hope the government will stick to it.there always seems to be a way for them to get around things. My fiance visit the board this year ( after being denied 2 years ago). the only reccommendation they gave him when he asked what he must do to obtain his freedom was, "continue to be problem free, be good in other words. Of course my fiance is serving a life sentence for a crime he did not commit so it makes it harder when you wont admit to the crime.
Well GOD and GOD only has to the power, so i'm still praying & believing and want everyone else to do the same.
Thanks allowing me to communicate w/ others who know what I'm going through.

Would anyone know if my honey's appeal would go through... He was initially offered 10 years for his current offense, but was told by his pd not to take it because he was not a three strk canditate. So in following the advice of his COURT appointed attorney he took it to the box and jury found him guilty and was sentenced under 3 strks.

He recieved 2 sentences of 25-life concurrently and a few other things adds up to 27
