Does anyone know the internal process regarding visitation forms? How many can an inmate send out? How does the inmate obtain the form? Is it possible for someone on the outside to acquire the form on their own, fill it out, deliver it to the facility for approval and then make a visit? Does the visitation form have a tracking system coming out of the prison? What would be reasons for denial once the form was submitted? My friend told me he only sent out 3. A clerical staff member said he sent out 7, 2 had been denied. Why would he lie and 4 mo. later, tell me a story of his cellmates ex-girlfriend. creating or printing a visitation form off the internet and was able to call on him for a visit. I dont believe him or his cellmate? :-) I would like to know the truth. :hmm:

The inmate receives the form and fills his section out and then mails it to his visitor. There is no limit. I am pretty sure the only way is for the visitor to fill their section out and then mail it to visiting. I also don't believe they are available outside the prison. They are not tracked, once given the inmate mails them out or doesn't. Somebody with CDC will know who has been accepted/denied but can't give that information out.

the inmate is the only one who mails out the form. because it has to be sign by him. then you mail it in they just take it and give it to the visiting department. the inmate will recieve a reciept saying they recieve it.

I got one from a friend. She faxed it to me. I cut off the fax header, threw that puppy on the copier so it could be front and back, had someone forge his name, and sent it off!!!! (I was trying to save time) Then I got the one he sent me in the mail the next day! Regardless, it was approved, no problem.

O.K....I picked up some visitor forms before he went in, had him sign them, gave them to people to fill out and once we knew where he was finally housed, we sent them in. I was visiting 27 days after he arrived there. Also, sent a filled out form directly to him that he signed and submitted and was approved a few weeks later.

So it is possible that 5 people (his mom and myself would make the 7 ct.) on their own obtained visitation forms sent them in for approval, and the 3 that got approved has never made any attempts to visit? How crazy sounding is that??? Thanks to those who responded. :-)

Yikes! That could have been prosecuted; Penal Code 529(3), arguably 146a(b)(4) (if visiting can be defined as a 'thing of value')...

I would not recommend this approach, obviously.

FWIW, the CDCR's procedure on visiting applications:

54020.8 Visitor Application Procedure
All adult visitors shall be required to obtain the institution/facility’s approval before being permitted to visit, except as otherwise authorized in this article.
Visitor applicants shall complete and sign a CDC Form 106, Visiting Questionnaire. In order to retain the status of approved visitor, the CDC Form 106 shall be updated whenever there is a change in the visitor’s address, telephone number, or arrest history or periodically upon request. Visitors who have no changes to their personal or arrest history may annotate such by resigning and dating the existing CDC Form 106. The frequency of any periodic update initiated by the institution/facility shall be no more than once every two years. Upon receipt of an updated CDC Form 106 and absent information that would warrant immediate disapproval, the visitor shall be allowed to visit pending review and approval of the updated information.
A new CDC Form 106 shall be submitted prior to visiting any inmate returned to an institution/facility from parole, or admitted into a substance abuse treatment control unit while on parole Any visitor approved at one institution/facility, shall be approved to visit the same inmate upon a transfer to another institution/facility provided the visitor’s approval status remains unchanged.

The CDC Form 106 shall be processed as follows:
The inmate is responsible for mailing CDC Form 106 to any prospective visitor(s).
The applicant shall return the completed form with an original signature via a common carrier, or personal delivery to the institution, Attn: Inmate Visiting.
The CDC Form 106 shall not be accepted from inmates.
Visiting staff will process only those Visiting Questionnaires that have been sent by the inmate to a prospective visitor in accordance with the provisions of CCR Subsections 3172(a) and (e). Forms reproduced from any other source, such as from an Internet download, will not be accepted for processing.
Some other legitimate Verification of inmate mailing of the questionnaire may be proved with an original dated signature provided by the inmate on the form in
question. Questionnaires lacking such inmate mailing verification may not be processed absent alternative proof that the requirements of 3172(a) have
been met or there is explanation for the absence of a signature.
Acceptable explanations for the absence of a signature include, but are not limited to:
A documented physical and/or mental condition or disability that may exclude the inmate from mailing and/or signing the questionnaire.
Verification of inmate mailing has been established by other means such as a date officially stamped by the institution or by a staff signature.
In accordance with CCR Subsection 3172(e), the visitor has been directed to update a questionnaire on file by designated staff in conjunction with a periodic
review or a change in name, address, telephone number, or arrest history.
When the completed CDC Form 106 is received and processed at the institution/facility, the inmate shall receive a CDC Form 887, Notice of Visitor's
Approval/Disapproval.
Inmates shall be responsible for notifying visitor applicants of their approval to visit.
Visitors may be required to contact the Department of Justice regarding their criminal or arrest history.

54020.8.1 Approval/Disapproval of Application to Visit
The authority to approve or disapprove a CDC Form 106 shall not be delegated below the rank of correctional sergeant, parole agent II or correctional counselor

An application to visit may be disapproved in accordance with CCR Section 3172.1.

54020.8.2 Arrest History Inquiry
Upon receipt of the CDC Form 106, an arrest history inquiry shall be completed, and a determination to approve or deny visiting should be made within 30 working days at a minimum, a Criminal Identification and Information (CI&I) report shall be obtained if the California Law Enforcement Telecommunication System lists a CI&I number for the applicant.
Reasons for delay beyond 30 days may be provided to prospective visitors upon inquiry by the individual applicant.
Notification
If the visiting application is disapproved, the applicant and the inmate shall receive from visiting staff via CDC Form 887, written notification of the disapproval and the process to appeal the decision. The visitor shall be informed of the specific reason(s) for disapproval.

54020.8.3 Reconsideration of Disapproval
Reconsideration of disapproval shall occur at the end of the denial period upon receipt of a new CDC Form 106 subject to the provisions of CCR Section
3172.1.

54020.8.4 Revocation of Approval to Visit
An individual's approval to visit may be revoked when:
• Information that would have resulted in visiting denial becomes known after visiting approval has been granted.
• Any activity or event occurs subsequent to an approval to visit that would have resulted in disapproval of the initial application.

Was it sketchy? Yep. Would I recommend it? Probably not. Did it work? Yes it did. But honestly, he did sign and send me a form. Just not the one I submitted. Are they going to do signature verification on every application? Fingerprint verification? Stamp the forms with the same invisible stamp they stamp our wrists with as we enter, so they can verify form origination? I suppose they could. There's enough bureaucracy, enough red tape, and enough hoops to jump through that it's probably not going to happen any time soon though. After all, I tend to think that prisons are more about protecting us from the inmates than the other way around.

As far as prosecution goes, most states require that forgery be done with the intent to commit fraud or theft/larceny, and that clearly was not the case. I just wanted to see my husband.

146a(b)(4) - why do you think this? I wasn't impersonating any public officer, investigator, or inspector in any state department. I'm curious as to why you said this! I love learning about just about any old thing, but I don't see how this applies at ALL.

I'm surprised you didn't mention 470(b). Out of all of them, it seems the closest to what happened, except that there was no intent to defraud.

Does this mean if he was released then violated and sent back I need to fill out another form? He says I am still approved to see him. I dont want to drive down there and not be approved. Is there a number i can call and ask if i am approved or not.

I've got several visitation forms from PVSP. My fiance brought him home with him in May...He's on his way to reception FOR THE LAST TIME...haha...at least if he goes back to PV I'm ahead of the game...doubt I'll be able to visit anyways.

My husband just went in to wasco a month ago and I haven't yet to talk to him. Well my BIGGEST PROBLEM is that when he went to jail I was 5 months pregnant with his first baby A BOY. But you see everybody, I ended up having complication's and lost our baby, not even a week after he was taken to wasco. So he doesn't know yet and to be completely honest it would kill him (as it would any man) to find out about something like that in a letter, and I just cant find it in me to tell him in a letter!!
So please if anyone has that form would you please reply back?????? PLEASE!!!!

He needs to have signed the form before the institution will accept it (normally; sometimes CDC's people don't do their jobs). He has to send you the form signed, you fill it out and return it.

Given the circumstances, though (sorry for your loss), you might be able to do an emergency visit without prior approval; it won't be contact (though if he's still in reception, it wouldn't have been contact anyway).

I can't find a cite to support this in Title 15, but I know the prisons have latitude to approve an application on the spot (if your background is clean) for exigent circumstances (in one case I saw, a daughter had travelled over 1,000 miles for a visit to her mom on Christmas without knowing about the CDC106/approval thing; once the waterworks started a sargeant took her aside and did the paperwork instantly).

Worth calling the prison and explaining the situation. Else, it can take a month or two for the prison to process the 106 (assuming they don't reject it for lack of the inmate's signature).

The CDC visiting guidelines require that the form (cdc-106, visitor's questionnaire) be sent by the inmate, signed by the inmate on the reverse side, in a box just to the right of where the prospective visitor signs it prior to returning it for processing.

The ONLY appropriate ways to get a 106 are
:from the inmate himself
or
:from a friend/family member to whom the inmate has sent extras for this purpose.
