Hi, I was sentenced on Oct. 4th, and my attorney said he will file for a reconsideration of sentence. Just wondering if this helps at all. Any info. on this would really be aggreciated. Thanks!

Thanks....adele I'm not an expert here, but my understanding is, that there has to be some reason, such as poor legal repsentation. To do this, I think you need to file a 2255 motion. In my case, the judge said he will reconsider or re-address the sentence, if BOP does not place me in a FMC. Thanks Mike FrustratedGirl 10-27-2005, 05:08 PM If you were sentenced prior to the Supreme Court decision in Blakley(or is it Booker, I get confused), which rendered the sentencing guidelines advisory and your case is still open your attorney can request a reconsideration. There are many legal technicalities involved, all of which give me a headache. My b/f is dealing with this right now. He was actually given an alternative sentence that is lower than his guideline sentence, but to have the BOP recognize it he had to file such a motion. |
