Brad & I were just notified that there is some guy that
" Oversee's" what the parole board does. I guess it's like the "Internal Affairs" dept. of the parole division. Now I cant seem to get any concrete information on this and don't know where to start looking and was hoping that someone here might know something about this.

We have decided not to go the appeal route because if Brad's appeal is held up in court for whatevr reason and it comes time for him to see the board again, the board won't see him. They will say something along the lines of " must wait to see the out come of the appeal before we will consider
making another recommendation for or against parole." So, if that happened, Brad could end up doing another year on top of the 12 months the board has given him now. So basically, we would get screwed twice or more.

It seems like the only chance we have is to get this reviewed by this guy that oversee's the parole board. If this guy determines that the board acted in error, he would order them to re evaluate Brad and this time they wouldn't be able to use the same reason's to flop him that they did this time.
And as soon as he orders the board to do this, they would have to see him for a hearing as soon as possible. Which means the next time they come to his prison to do parole hearings they would have to see Brad.

So, if anyone knows anything about any kind of Special consideration hpolicies, would you please forward the information to me?

Also, anything I find out about all of this, I will post here, so hopefully it will help prevent some of you from going thru this,
and hopefully your loved one's will be able to come home when they are suppose to. Even if none of this works for us, if it can help some of you, that would make all of this worth it.

Looking forward to any help anyone will be able to give us.

Deb posted a name and number of some lawyer who works with tickets or somethign. Anyway, I'm not saying hire the guy, but call him and see if he knows who this other guy is that "overlooks" parole errors. Don't know if he'll help, but it's worth a shot, and at least a place to start. Good Luck hope everythign works out for you and Brad.

I guess I'm confused. The internal affairs division deals with facilities, employees and etc. as far as policies and rules go. I guess if the parole board violated a policy or law you could go to internal affairs. Steve Marschke is the head of internal affairs now and he used to be the chairperson (head) for the parole board. John Rubitschun is now the chairperson for the parole board.

I have never seen the parole board hold up someones next review while waiting for the court. I have however seen the court take so long that the guys 12 month flop was up. So that can just be a big waste of money depending on the case.

Either way you are still going to have to prove with evidence that they erred.

I didn't mean we were going to the internal affiars, I just used that as an example.

About the flop thing, this has happened to 3 people Brad know's that appealed a 12 month flop so that's why we don't want to take the chance ya know? 12 is long enough, we would hate to make it longer.

The person we were told to send our stuff to isn't the chairperson, it someone that reviews things the board does. I havn't been able to get more info yet, but we are going to send it to this person and wait to see what happens.

A friend of Brad's got flopped in february and did this, and he has a new hearing in August with the board. We aren't getting our hopes up tho, cuz nothing has went our way yet.

But we are also going back to the original sentencing judge with the paperwork to, so hopefully with the two of them maybe something will go our way for once. But if not, it's only 12 months right.

And we did take your advice you gave me earlier about getting it in writing about him not being allowed to take that class. He got the letter today and we are enclosing that to, so thank you for that advice. Maybe it will help.

I didn't even know such a person existed. So when you get the info I'd really like to know. I try to help all the guys I can with whatever information I can get my hands on. I have watched so many that I know would do good if given the chance and they get flopped and guys that have tickets up the yin yang and you know that they will be right back get paroled. The shortest parole I've seen so far was a whole 6 days before they screwed up and were back. I wish you guys all the luck and I think with paperwork backing you up you should be able to get somewhere. My fingers are crossed.

Thank you , you have been very kind to us and I won't forget it.

I agree with you about the people that get paroled (some of them) it seems like they only parole the ones they know will be back so they can get more money from the state for them, and the ones that they really think won't be back anytime soon, those are the ones they keep the longest!

Brad knew of this person who came to prison after he did, for the same thing, got a lot of tickets, got paroled, screwed up, came back and got more tickets and they just paroled him again!!!

So you tell me, where is the justice for that???

I have no sympathy for people who get paroled and then screw up and get sent back to prison! I think if that happens, they should be made to stay in prison for a long, long time!! They had their chance, now let them sit there for a while and see what they screwed up.

Anyway, when I find out something I'll let you know.
