View Full Version : Open 10, what does it really mean?

My husband is facing a sentence of an open 10. He is at the OCCC now, and will go to Halawa after sentencing. I am in New Jersey, that's where we live, so I don't understand the whole thing about the open 10 and the paroling authority. The lawyer says that the judge is considering either 2 years, 3 years 4 months or 6 years 8 months. I'm confused. Can anyone explain this system to me? Thanks

Aloha, Gordonville and welcome to the Hawaii Forum of PTO. I don't really understand the "open 10" thing. I'm assuming that it would be max 10 year sentance but his time on the inside will be based on his RAD score. They get that score during an evaluation process when they're transferred over to Halawa. I'm also not sure what that process is either, but believe that they look at things like any previous convictions, education status (did he graduate or receive his GED) and other such stuff.

hello, my husband was also given an open ten and i asked the same questions as you are, he's been in there 2 years and the only answer i think to give you is that he has up until 10 years maximum but will probably end up with a 5 year term in which he might be able to be released after serving a madatory minimum(it depends i think, approx 18mos>)then depending on his classess and meeting requirements he might be able to be out in 3 or so.. anyways im no lawyer so i just hopes it helps a bit for you.. aloha
