Ok, just got back from a visit with Harvey in Morgantown and have a few questions for anyone who has survived the federal system.

Harvey's good time date is 12/24/03 He is supposed to get approximately 3 months halfway house time. My address which is where he will be eventually is listed now as his temporary address even though we have been trying to get it as his address of record. He was told that his previous probation officer had to approve the "move" How likely is this to or not to happen?

Second, Harvey and I want to get married once he is out and on his feet again. He has right now 3 years of supervised release after he gets out. Do we have to go before his probation officer to "approve" us getting married? If so what is the process and how long does it take?

Third, I want to work on getting Harvey a job before he gets out so it is waiting for him. We are initially thinking something like a Home Depot or Lowes since he has a lot of skills in that area. How "felon" friendly are they in hiring? How does one approach the management at the store?

This was Harvey's one and only offense for a white collar crime. He's been a successful businessman for over 30 years

Finally, what is the likelyhood of getting permission for Harvey to travel with me to Indiannapolis, ID in November of 2004 (3rd month of Halfway house time)

Any advice would be appreciated.
Thanks
Ellen

Ella,

I will be having the same problems you are experiencing now. However, Billy is not eligible for halfway house, so his time is a straight shot. He also has 3 years probation upon release.

Billy and I have talked about what will happen with his PO, etc. He says that since I'm living with my mom now, I will have to get us a place at least 6 months before his release so his PO can approve the home. Right now his address is his parents'.

I don't know if Harvey can travel with you while he's at the halfway house, since he'll still be in federal custody.

I do know that if Billy wants to travel with me, he has to get a "pass" from his PO. He won't be able to move out of state until he stays here a year. Then he might be able to transfer his probation.

I wish I could help you more, but I'm in the same boat you are. Billy will be released in April 2005, so I have a little more time to figure everything out.

As for the job situation. I'm already working on trying to get him a job. It will be difficult, but not impossible. I read somewhere that businesses are more likely to run a STATE criminal check than a FEDERAL since it would cost more.

Anyway, I hope you find the answers you seek.

Hugs,

Well I own the house where Harvey will eventually be at so this has been my permanent residence for almost 8 years. We have moved all his mail and his driver's license and stuff to my address but were told that it still needs to be approved by the probation officer. I wish they would just put him on home confinement for the last 10 percent of his sentence but I've been told that its extremely difficult to get. We shall see. One step at a time is the only way I can deal with this mess.
Thanks for your thoughts.

ok, I screwed up a bit on his release date. It is unfortunately 12/24/04 not 12/24/03 (lord I wish it was this year)

Does anyone know what the guidelines are for home confinement. My sweetheart is not due to release until 06 but I would like to know more about this because I understand that to go into a 1/2 way house you have to work. He had an accident and has a bad back and a bad knee, he is in pain all the time so I think he probably won't be able to work. Where could I find info on this home confinement process????

egreenfield: 04 is right around the corner...it will be here before you know it...and it will all work out Harvey will be home before you know it good luck!!!

Well I did find out quite a bit of information from the yahoo group ********. Home confinement is usually limited to the last 50 % of a ccc placement. There can be exceptions but they are of course rare. Once a person is on supervised release there is no restriction on getting married. I also did some investigating about finding Harvey employment initially and it looks like it will be doable. (Thank heavens)
