FALSE ARREST, HARASSMENT, MALICIOUS PROCESUTION, CONSTITUTIONAL VIOLATIONS COLE COUNTY, MISSOURIJul. 22, 2005Okay, I have a criminal history, not just a few convictions, but a substantial amount of convictions, mostly for Bad Checks, Misuse of a Stolen Credit Card, & Forgery, basic white collar crime. Now, I have no excuse for my consistant behavior over the years and I make no excuses, I did what I did to suvive, simple ! I have no regrets and I don't ask for pity. What I do ask for and demand is respect and equal protection under the law, along with whatever else I may earn along the way.
So, back last year I overdrew my accout at Home Savings Bank in Jefferson City, Missouri, not a big deal, one of the many times I had overdrawn the account, hell I had a check bounce on me for $6,999.99 when I first opened the account, and guess what I paid every ******* cent back to the ***hoes, did I have to ? No ! But I got married a couple years ago and have done everything in my power to walk the straight and narrow, not that I like the straight and narrow, in fact just exactly what the h*** is the straight and narrow ? Is that something like the the example the Cole County Prosecutor set when he violated his oath of office, used his office to ***it his brother or sexually har*** the clerks ?
Anyway, So back in August 2004 I went to my bnk and withdrew $ 1,500.00 from my account at the Teller Window, of course I asked what my balance was "prior" to withdrawing the money. The notify me as always that my account is overdrawn by $ 1,308.00 or something like that and I say okay well you know I will take care of it. Time comes and goes and soon November is here, I received an Official Cashiers Check from this ***hole named from Dolton, Illinois, who I sold this movie camera to I had bought from some flea market, estate sale or something in Kansas City, Missouri. Of course I trust the prick and agree to half up front and the other half by Cashiers Check upon receipt, after all it's C.O.D. right ? Should be full proof ! (**** No!) The ********** gets the merchandise and on the very day unbeknownest to me he goes to Charter One Bank in Calumet City, Illinois and tells them he's lost his Cashiers Check and they proceed to place a "fraudulent" Stop Payment on the damn thing. Meanwhile, idiot that I was, and you'd think prison if anything would have taught me not to trust no one, I went to Home Savings Bank and cashed the Cashiers Check. After Cashing the d*** thing I thought the least I could do was cover most of the overdraft on my account, so I deposited $ 1,000.00 dollars in the account and kept the rest leaving my account still overdrawn by about $ 300.00. This all occures November 22, 2004.
I hear nothing from the bank until the Cashiers Check comes back with a stop payment on it, and feeling guilty I write a letter and tell the bank that I will cover the Cashiers Check, I don't know how or when but I will do it because I felt I owed them that.
Then I get a letter from Home Savings Bank President who says that if I don't pay the money back post haste he's going to file criminal charges against me, of course this isn't the first time he made that threat to me, he made it before when the $ 6,999.00 check bounced that I deposited. But do you think for one ******* second that the Cole County Prosecutor gave a **** when I took that check to them for prosecution ? No, they told me there was nothing they could do, I was basically beat. Now if I had been just regual Joe Citizen, you know d*** well that ***hole would have been all over that check like a cheap suit, but one of the prices you pay for being an ex con is that when you get ******, don't ask or expect help from either the cops, prosecutor or the courts, because they could give a **** less about you or your troubles. The only time there intersted is when they can find a way to **** you themselves and then it's on like donkey kong.
So, time p***ed and then comes June of 2005 when I get a call out of the blue from the Jefferson City Police Department asking me about the overdraw on my account at Home Savings Bank. I explain the situation to him and just to be on the safe side which "all" ex cons must do, I wrote a letter to the Cole County Prosecutor just so they knew my side also, after all the cop sure wasn't about to tell anyone the truth and nothing but the truth, they twist what you say until it meets with what they want it to sound like, kind of like a reporter does with politicians.
Next thing I know there's a warrant out for my arrest alleging that my actions constituted Check Kiting. Of course the story had now changed significantly from the actual facts. Instead of there actually being $ 1,500.00 dollars in my account when I withdrew the $ 1,500.00 it was now a mistake by the teller, oh and it was another mistake by the teller that the Cashiers Check was cashed.
So, I wait and obtain the discovery from the prosecutor and wonder of wonders, not a *** thing makes since until I notice that at first the lady from the bank told the truth, but when she told the truth, the truth didn't fly with the Cole County Prosecutor, so it was sent back to the Cops, then came Officer W, and lo and behold R V whole story changed in it's entirity.
So, it didn't take a genious or someone with an IQ to see that this was not about my actions, this was about how the Jefferson City Police and Cole County Prosecutor twisted my actions around, had R V change her story until they could turn my actions into something criminal.
First of all, just how in the **** is it against the law to overdraw my account ? H*** normal non ex felons do it so much they now have overdraft protection, wehat those people don't know that they have no money in the bank when they write there checks ? Of course they know, but the overdraft protection is designed to protect the regular Joe Citizen, it does not apply to ex felons, because if there overdrawn on there account then they must be commiting fraud or stealing or something against the law.
The comes the Cashiers Check, just exactly how in the **** am I responsible for someone else placing a fraudulent Stop Payment on a check ?
You know, sometimes I honestly believe that I was better off as a criminal, at least I knew exactly where I stood and believe it or not there was and is honor among criminals, and sometimes I honestly think there was more honor in prison than out. God know's I made 100 times more money in prison than I did out. Not by doing anything criminal, I was no big time drug lord or anything like that I was a Paralegal and I made a fortune helping other prisoners. Out here Im lucky if I can get a job at a fast food joint, and I will never be more than manual labor to all the other jokers who possess half the knowledge that I possess.
If society in it's infinate wisdom had there way, and to date they have then no matter what you have done in your past you "will" pay and pay and pay and pay for the rest of your life and every time you do anything right they will find the wrong in it and every time you get a leg up they will be there to make sure they knock the ******s out from under you.
When does it end ? Must I and other like me be forced to live in the gutter and suffer at the hands of those in power just because we have a criminal record ? Is it just that you get charged with a crime were there is none just because you have a criminal record ? **** No ! Everyone has something to hide and there are those sitting on the bench, and wearing badges that have done far worse that I have done, they have taken the Judicial System and made a mockery of it, there is no judicial system anymore, and you damn sue aren't innocent until proven guilty, it's all a bunch of horse **** feed to the public to make them believe that more tax dollars need to be spent on housing criminals and bringing them to justice, but I defy any person to go to your local Courthouse on Law day and look around, you don't find middle cl*** people in there, and you damn sure don't find the wealthy, what you find is the back bone of this country the poor ! And they are steped on and abused witrhout mercy, they appoint a Public Pretender to represent these poor slobs and they do not possess the knowledge or understand that the Public Pretender is nothing more than a puppet for the court and the prosecution, so in the end they get screwed ! Were they really guilty ? Most of them of something I have no doubt, but does that give society the right to punish them and hold them to higher standards than everyone else who has means ?
I have spent my entire life studing the Law from both sides and I cantell you this without any doubt, the law is in and of itself a beautiful thing, and it is not the laws that are corrupt, it's those who are administrating the law that are corrupt and pervert the law into some unholy thing. The law is not about who can afford the best defense, it is supposed to be in and of itself just and equal and not based on race, past criminal behavior or financial status.
When are the people in this country going to open there ******* eyes and see this for what it is, stop ******* watching the Tv and beliving eberything the self serving politicians and reporters tell you, they want you in fear, they want you off balance and they want you unable to think for yourself because then the power is ther's to weild in any way they so choose without mercy and without concern for who they hurt or unfaily punish or prosecute. I defy anyone and I mean anyone to look at the evidence the Cole County Prosecution has presented against me and find a crime, what you will find is that I have done "nothing" that 99.9% of non criminals have done, but because it is me my motives must be suspect.
Society wonders why recidivisim is so high, why criminals prefer to keep committing crimes, well the fact of the matter is, what choice are they given ? Ther d***** if they do and d***** if they don't. No one trusts them, they can't even make enough money honestly to feed there family when they can find a job, and they are consistently persacuted, and they finally just get to the point were they say **** it ! Since the powers that be are going to **** me anyway I might as well give them an excuse.
I personally have not reached that point yet and I hope and pray every day that I don't, I'm too ******* old for this **** anymore. I will not go into the night without one hell of a fight, and I for one will not sit by and allow the powers that be just **** me and think it's okay because it is not. The sad part is that if every single person sitting in jail or charged with a crime were to "demand" a jury trial it would bog down the system so bad that the courts would come to a complete standstill and believe it or not that is exactly what it is going to take before society wakes up and realizes that there are one hell of allot more ex cons than they ever thought. We all have the power within us to stop the madness, it's all about orginizing and seeing to it that Justice is brought back into the courtroom and not some figmet of our collective imagination.
