I just need to get this off my chest. We have been waiting for 5 months for my husband court trial papers to be ready. Told it could be another couple of weeks. This is making me stress out even more!!!! I wont get his paycheck until the convining authority makes its decision, I need that money for the new lawyer I have found. They just take there time as we sit out here waiting for them. I am ready to pull my hair out the lawyers say their is so much stuff to appeal but they cant do nothing until the military get off their butts. I just wish they understood what it is like for us, the family. Just needed to vent about our lovely goverment.

Honey, from your post it seems you are waiting on the trial transcript to be made and sent to the attorneys (both sides). Once the attorneys receive it, they will review it and submit errata (any corrections they need made to the transcript). After that, it will be finalized and ready for the attorneys to use in forming their issues for appeal. I know it's tough, but try to be patient. I'm not sure who you might contact to see if there is any form of advance on payment that might be made to someone in your situation. I'll see if I can find anything. Ask your husband's attorney, or contact the Personnel or Pay office at the base where your husband was stationed, or at least where his command is based. Even if they can't help be of immediate help, they may be able to direct you to someone who can. Best of luck, hon. Hang in there. And feel free to vent anytime! By the way, (because if I go look, I will lose this reply, where was your husband stationed, which service branch, etc.?

He is Air Force. The trial records I was told would have been done at the end of April but they still are not and now it is June. I have called the pay office and they stated I would recieve his pay once the convining authority approved his sentence. It is just a waiting game and I am tried of listening to the papers will be done at this time and they are still not.

Honey, I know this isn't any help, but my son's sentencing hearing was in July and we received the Record of Trial (including the Article 32 hearing) on Christmas Eve. The preparation of the Record is a very important step in the process. Your husband's attorney will need to read every word of it to make sure he/she agrees with each statement of fact, etc. To approve it without doing so could cause the loss of an issue for appeal. The same goes for the government. My son's pay continued until his sentence was approved, so I'm not sure why there is such a difference between the two service branches. I'll see if I can find a regulation that sets out the procedure here. Maybe it will give you some insight, or a way to get around this obstacle. Keep knocking on doors, though.

Same thing here, my husbands pay is continuing until his sentence is approved by the convening general. He is Army. His trial ended in early Sept and we are just now, hopefully, getting the record of trial approved and entering the clemency phase. Hopefully we will see some sense come into play here and his sentence will be severely reduced.

I dont understand why I have recieved three of his paychecks and then they stopped. It was stated because it has to be approved with his trial dockets by the convining authority. Maybe they changed their minds about me recieving his pay and noone will say that.
