View Full Version : Help please!! My husband just got sent to the Brig

My husband was taken to the brig at Camp Lejeune Saturday evening, and I have no idea how to find out what is going on. As far as I know he was considered awol (long story that includes a lying first sgt.), and I have no idea how long he will be there, if I can get in contact with him, who I can call to get information from, etc.

My son and I are living in another state right now, so I can't find anything out in person, but I did call and leave a message with the chaplain. I figure he is someone I can trust that would be willing to help me find out what is going on. They have also taken ALL of his pay, and from what I read about military law, the maximum charge for awol (less than 30 days) is 2/3 of your pay taken and 6 months in the Brig. I don't understand how they can take his pay, etc., before he is even found guilty.

I would also like to know what this military prison is like, if anyone knows.

Any help would be VERY appreciated!!

They can hold him in the brig until the trial if it goes to trial. Call one of these numbers they should be able to help you find out who his lawyer is. His pay can be given to you if they take it from him but the lawyer must put in for it and then it must be approved. You will still have medical and base privilages. Do you know his commanding officer if so call him and he should help you.

Do as honey says -- call his commanding officer -- your location is Ohio (Butler) -- PM me with a number how to get ahold of you -- I'm up here at Wright-Patt not to far away and there is someone up here that can help you and I can put you in touch with them. They can get the ball rolling as far as finding out what is going on and helping you with the pay and so forth.

I will keep you in my prayers and we will do whatever we can to help you -- try to stay calm for your son's sake, okay?

Thank you, both. I'm definitely staying calm and doing my best not to worry about him - thanks! God is taking care of us and I know everything is working out according to His will - but I still want to know what is going on and get his pay back if I can, lol.

My brother is getting married this weekend and my son and I are in the wedding, so I'll probably be scarce for a couple of days. Thank you both for your help. I really appreciate it.:)

My husband just got out of the brig last night - while we were at the wedding.;) He was there for a week and requested (whatever it was that got him out and I can't remember what it was called, lol), and he has a lawyer and he's on restriction right now awaiting court marshall. I'm glad I don't have to try to figure it out for him, but thank you both SO much for being so helpful. If ever I need help again, I'll remember where to come.:)

He is supposed to get paid on the 15th, so that's great too. Again, thanks so much!

Even thought the military can do plenty of things with no accountability, anyone who is put in pretrial confinement has a certain set of rights found in the Uniform Code of Military Justice. Pretrial confinement sets in motion certain times that must be followed by the command. YOU NEED AN ATTORNEY. The military must provide a detainee with counsel or you can hire your own counsel.

Wrong, the military does everything with accountability. If your husband's 1SG is lying, call his BTN CO or the CSM and use the open door policy. There are muster sheets which have to be entered in to the computer daily, he would have to be playing with muster sheets which would show an edit made to them; or if other people can confirm he was there then its useless to the 1SG.

Now as far as taking your pay, let me first ask you was he AWOL or was he UA (Unauthorized Absence). If he was AWOL he would lose all pay while in the brig because he is given the temp rank of E-1 and fined the full amount and regain it all upon release. If he was UA, he is fined a certain amount and locked up. Chances are they will bust his stripes on both occassions, but if he is found not-guilty then he will be refunded all pay and losses.
