No. If she goes to halfway house, she will possible eligible for home confinement at some point. She is still considered in BOP custody until her projected release date, so her PO would have no say so.

I'm not sure but I think this is something that your niece's attorney would have to present to a judge for approval. The PO does have something to do with the home confinement as they will be supervising you just like when you are on supervised release or probation. While I was at Coleman there was a girl who was able to get half of her prison sentence reduced to home confinement through her attorney while she was in prison.
