Coreysstuff 05-16-2005, 02:43 PM My hubby told me there is a website that you can go to to see where the appeal is standing and if they have made a decision and all of that but he didn't know where. Does any one know how to find it?????? I don't even know where to begin. I would love to check on it.:confused:

There ya go.... though it appears that Colorado requires that you either contact the court directly or use one of the paid services to obtain information.

Click on the District you need to find info from....
Names are not posted to the site until a decision has been made, however....
so there isn't any way to find out the status of an appeal. If any oral hearings are scheduled, that case also will not appear on the web site.

true findings on murder an attempted murder
not true findings of a weapon
not true findings of of the person who murdered victim
not true findings of the person using the weapons
so i dont understand how you can convict a person to murder
if you dont have evidence of weapon and you find that the person who supposed to murdered the person did it.
so we already know we have a case full of loop holes. Now were trying to find some one to take the case that we can afford

The case can go to the Californa Supreme court for review most do. Most of the time the Supreme Coyrt agrees with the Appeals court. Once you have exhaused all state remidies. You can got to the Federal courts and challenge Comsitutional issues, or see relif through the writt process

Then you can read briefs replies and opinions. You may have top use PACER a service 8 cents a page to view the docket. I found the opinions etc for free He won. Just find out what district that state is in; this was Arkansas and the court of appeals is in St. Louis. You can also call and a clerk can tell you what stage it is in good luck

Our son is trying to file an appeal as they write him up as a refusal and he has shy bladder but it wasn't noted in his presentence report. He can go if they put him in a dry cell and give him enought time and water. 8oz doesn't do it.

Doc's Sis 12-31-2006, 08:11 AM appeals must be stared within the first 30 days of sentencing. Right?? And at time of sentencing, judge asked if he needed a court appointed attorney to do the appeal. However, if he took a plea bargain he may not be able to appeal his conviction? If he is saying his attorney misrepresented him, he should file something with the State Bar Assoc....so do a web search for CA Bar Association and see what you can find - or call another attorney to get info.

azramirmohamed 08-25-2007, 07:43 PM I am new to this website, and I am having trouble finding what I am looking for, maybe someone can help??? My brother has been in prison for 11 years serving a 23 year sentence, from the time he was 15 years old. Our attorney ripped us off over $50,000, and in the end set my brother up to get a harsh sentence to prove a point to the prestigous Dublin, Ohio community. He attempted to rob a gas station, while he was high on marijuana, and drunk, in this attempt the 400 lb. man attacked him instead of giving him the $25 in the register. (I can't say what I would have done in his shoes?!) Well, in this stuggle the gun went off, and it was proven that the trigger wasn't pulled it went off, and proven to clearly be an accident. The man died instantly, and a couple hours later they took my brother in custody and questioned him in the state of altered mind, drunkeness, and shock. They did this without contacting parents first. They questioned him for hours, and after reading the transcipts, it is obvious he was a little delusional. He and his parently agreed to involuntary manslaughter with a maximum 13 year sentence, and they affirmed he would be out in 5 years due to shcok probation, and being a first time offender. WRONG! He was also bound over as an adult by a well known, former juvenile judge, and current president for advocacy for children, Mrs. Yvette McGee Brown, who will not respond to my letters. I have also written the govenor, who responded to my letter by not responding to anything I spoke of. My brother is currently 26, soon to be 27 in September. He has been through hell in prison, and currently has a severe case of psoraisis. (sp?) We have hired severel attorneys throughout the years, and filed appeals a couple of times. DEAD END. We were told he is eligible for judicial release. I need direction on how to file for it. Can someone help? I also want to do an online petition for his release. I am willing to answer any questions regarding this situation, due to my confidence on the person he is, and has become. He is definitley not the prison type. Someone please give me some feedback.:new: :new:

wildspirit 12-22-2007, 04:42 AM My friend's son has never until last month had a problem with his prison stay...then it seems things really went haywire when he brushed past a guard due to a dislocated knee (he says he fell down the stairs) and he was literally dragged in cuffs and put into Administrative Segregation for being a 'danger to the institution.'
He has been in touch by mail and has written an appeal which I am currently transferring to legal paper.
There is a huge problem, though, and that is, his aging mother received seven boxes with a checklist of items (personal belongings of his) but no explanation, no hint of why she received them.
I'm wondering if a person's human rights stop at the guard desk, and if the guards and prison staff are regularly examined by professional psychologists...the opportunity to develop and exercise sadistic tendencies is there, and I am afraid (since he described his injuries to his mother in his letter from Ad/Seg) that he has been victimized.
Please help me understand how the prison system operates when a person is assigned to Ad/Seg. He was planning to be released (with about 20,000 other California inmates) next year but now we don't know what is going on. I have contacted his attorney but he has indicated no expertise in that field (I doubt his expertise in any field). My suggestion to his mother was to contact her Congressional representative for help if she can't get any information (the only thing she has gleaned so far has been standard prison Public Relations Talk (BS).)

Here's a link to the Tenn Board of Probation and Parole. I didn't see any way to check on the status of a parole hearing appeal, but there is contact info on the site and an FAQ that might be helpful to you.

Have you checked your court's web site to see if it has an FAQ that might give you some indication of how fast cases are moving? Paralegal USA 07-01-2008, 12:05 AM An appeal from the judgment of conviction, based on the trial court record, is taken to the District Court of Appeal. If denied at that level an application for certiriari can then be taken to the State Supreme Court. If denied at that level, a petition for habeas corpus can be filed in the federal district court pursuant to 28 USC 2254 (must be filed within one year of denial by the highest state court), and if denied by the federal district court, further appealed to the federal circuit court of appeals. A final application for appeal from the judgment of conviction can be filed in the form of a certiorari application to the U.S. Supreme Court.
Other post-conviction avenues are also available in most states, including, but not necessarily limited to, state habeas corpus proceedings and writs of error coram nobis. In some instances those types of actions are also appealable.

Their recorded message gave me the web site and it also had a phone number for help. The help number explained to me how to get the information emailed to me. JeanettaAnn
