It is me again. Thank you for your advises. My lawyer told to file a K-3 visa the next time when I am in the state. I belive she is a very good lawyer and she has a personal interest in this case (Foreigner wants to stay, because husband is on d.r.) Does someone of you ever filed this kind of visa?? Or know someone who filed it?? Or is foreigner and married with a man on death row and moved to the states??? Which kind of visa you used??? I know alot of questions, but this is an important step in my life and I no want to mess it up. I want to be in the states when my husband comes home one day.
I am sure you will have some good advises for me THX!!!!!!

ooooh its the same as i need! i didnt know it was called the
k-3! im gonna marry and apply for this thing too. i think this is the visa to get permanent residentship...right? i always call it the greencardvisathing :)

Hey Mara!! It will be not that easy.You need to stay 90 days in the states at day 91 you will file for the K-3 visa. They have to approve you. You will receive your work permit during the next 90 days. That means that you need to stay 6 months without work. After that you will have an interview at the local INs office. The INS officer will deny you. Then you will have to go to court. That will end before a judge at the federal court. But there we will have very good chance to win. This will not happen during the 6-10 years after you filed the visa. But as long as your case is pending you are allow to work and stay in the states.But your man will leve the prison soon and then all will be ok. i came in on a k1 visa, dont know if thats much different or not then the k3, but heres my input! i had to file for k1, then when the application was accepted they sent it over my local embassy (in your home country) and i had to go for an interview there. they did do a criminal background check on me and my fiance, and said if either of us had a criminal history we would need a 'pardon' before our application would be approved. neither of us did at that point so my application was accepted.
you cannot have an interview for the k1 visa in the us, it MUST be in the foreign country's embassy. you also need to show proof of income for the us fiance, and if it isnt enough you need a co-sponsor (someone willing to support you if something happens to your spouse). the co-sponsor must make at least 30,000$ a year and be a us citizen.
