Ok well this is one of those things that falls under the- who else can I tell that will understand or care? So here goes...
My fiance is in Talawanda (the min across from OSP) He has been in since last May and been at more than 4 different facitlies- I not only been cleared to visit at each one- but have been to Talawanda 4 freakin times since he was transferred there- all without a hitch!
Some of you may be aware that his grandmother passed away and there has been alot of problems with them saying he could attend the funeral- they would say yes, then no- I finally involved a family member with some pull- it went to the warden and he was approved to go this Monday.
Today when I arrive to visit- I am denied entry because I have an "arrest record and am a convicted felon"!!
Ok first off- if I had EVER been arrested I think I would remember it!!- Ok I didnt pay a failure for wearing a seatbelt ticket once- but I went to court-pled guilty it was reduced and cost me $350! Now in handwriting on my visitation form it says that in 2003 I was convicted of : assult and battery, intent to distribute herion, oh and 3 other things she wouldnt let me read...because "I know my record- that I tried to conceal"-- now maybe I was dropped on my head a few times as a baby- but I'm pretty sure that I had I been arrested and convicted of these crimes in 2003 I not only would have some knowledge of it or probably be incarcerated myself. Now it looks as if I have a record that rival's my fiances!! ( And he thought he was the bad one!!! ) Of course they refuse to re-run my name- and I'm pretty sure it's retaliation against me for having a family member that went over some people's heads over the whole funeral ordeal!! And it's Sat- so it will be at least Monday before I can contact any office that can provide proof that I have no arrest record--- Now trust me I don't have a perfect past- and have been clean over 17 years- but I can quite assure all of you- had I ever been picked up or arrested with herion- my intent would not have been to distribute it!!!
Needless to say- this is another prime example of how they 'punish' people that voice any complaints- especially when they win!! I'm thinking I can probably call Tulsa county records Monday- as this is where I apparently commited these acts - and get some sort of proof to prove I have never been arrested. As well I could call back my cousin- who would take care of it- probably by calling someone at home and raising all kinds of heck--- but what happens then? They'll still find a way to punish him- since I fought back! Does it ever @##$ing end? I mean what do you do? They know they'll find a way to get back at you somehow- and I'm afraid Sam will be the one to pay. And of course they wouldnt even do me the courtesy of letting him know I had come and they denied my visit- and he hasent called (of course it's 2 1/2 hours each way!) so he probably thinks I've deserted him:cry: or they've blocked my number so he can't call- because it took them a year to decide I was a felon- although no one ever bothered to inform me!

Ok - feeling a little better - Thanks!

ooohhhhhhhhh honey, i'm sooo sorry for you! i'd hate getting put thru that, especially when your just minutes away from seeing him!, i'd also have to say to call the warden and explain what happened, let them know all your frustrations and how they humiliated you, but don't raise h*# and take it out on him.......when i had a visiting issue at my guy's prison, i needed to contact the warden and he was great, i saw some changes come out of my issue..........so good luck!

Try this, Inmate vistors are routinely checked for background checks ( this is where the arrest records, convictions and prior charges are located) This is done through NCIC checks and local databases. It is the same thing that is done everytime the police stop you

If you have not done any of these things then it is highly likely that the rap sheet or database check that was done could be attributed to someone else. This often occurs when common names. common birth dates etc are used. For example Bob Jones with a DOB of 5/14/78 would return a rap sheet for every Bob Jones in the united states and all offenses he has been convicted and or arrested for. If you a Bob Jones who was trying to visit a inmate and someone were to pull this rap sheet they would not allow you to vist. It takes a extremley sharp and trained eye to make sure you have the right person.
Also i have seen incorrect entries that have resulted in the wrong information entered and serious consequences for the wrong person. I had a brother that had a DUI arrest and was one number off on the SSN that resulted in me getting accused of having a DUI

I suggest you in writing request that they check the information used to deny your visitation and phone list to make sure that the right person is on there. In this letter i suggest you make sure your DOB, FULL NAME INCLUDING MIDDLE NAME AND SSN is on it . Also make sure that you tell them that you have been visting for so long and it is confusing as to why your visitation is now cancelled.

LET ME KNOW HOW IT TURNS OUT

Dangit!!! I'm sorry for all this...grr.

You just keep telling yourself that YOU are right and it's a mistake. And it's a mistake that can be cleared up easily with evidence. Tulsa Records is the right place to call here but I can't remember if it's listed under the Courthouse listings or Police listings. Either department should be able to give you the right number though.

Like everyone else said, stay calm when you talk to the Warden Monday. If this *was* retaliation instead of a mistake, don't let them think it worked. Stay strong because you know you're right. You've put up with many battles since this all started I'm sure, this is one more that you can handle too!

You've still got my good wishes headed your way and I'll be thinking of you Monday too for sure :)

Oh my!!! sweetie, I'm so sorry that you are having to go through this.. This is horrible..

I know when I worked at Logan County Sheriff's Office the boss would run Background checks for people. I do think that there is a charge but I'm not sure how much. You might get you one, just so you have the paperwork in hand when you call. Now I'm not sure how long it takes but I'm sure that the county that you live in can advise you of cost and time to get one back. As far as that goes there are a few websites that you can run your own for a price. I'm sure that would be quicker then your local Sheriff's Office. I believe that it takes about 2 weeks from the Sheriff's office but I'm not sure.

I know that LCSO would love to be able to block me from visiting too.. They do everything they can but fortunately I have a spotless record not even a ticket <<knocking on wood>> I've been lucky cause I am no angel.. haha

Good luck with this.. You will be in my prayers. Keep your head up the wrong will be righted with patience and rememeber Calmer heads prevail.

I appreciate all your advice and reply's. I will call tomorrow and get some type of notorized proof of my non-record. I think it best to have the document in hand before I call the facility.
I have worked in banking- been accepted to the Peace Corp- all areas before, during and after my so-called offenses, and all places that do numerous background checks- I doubt they would have let me handle $100s of $1000's of dollars on a daily basis- if I had these so-called arrests and convictions!! - as well my fingerprints have been run through the FBI due to my position. I know I am clean.- This is just another one of the constant road-blocks they throw up whether it be purposely or just due to the fact they are morons!! I started to get paranoid- but I know this is completely ridiculous!!
Thanks to you guys I have some good info and currently calmer dispostion to deal with this!! But I have to tell you in alll honesty- I really felt like giving that 'assult and battery' charge some credability! LOL! Thank God my better judgement took ahold of me!
I'll let you all know what happens!
