(this is a little/ok a lot long... sorry.... it all just poured on out)
First of all, thank you to all of you who prayed for my man's court issue, for our family. However, the unfortunate outcome was a denial.:cry: They say he failed to show substantial proof and some goobly gopp about not being able to ask for his credits. So, I have some avenues to explore, so once again, busy busy... just feel like the world is falling down around me... I have final exams this week, and I need to figure his legal rights out as well. Unfortunately, none of the professorsI have now are allowed (some condcuct issue) to assist me with the situation, point me in the right direction... :slap: I cannot find an attorney who will take on what should be a simple request ( revisit sentencing, request the court to recalculate credits) on a pro bono basis or even otherwise since this isn't exactly an appeal, or like the attorney we had previously allowed me to file and do documents (work the fee off)
( he passed away in november) . so, I am at a loss, and just miss him terribly( although I did get to visit with him all weekend, thank God for that blessing)but it isn't the same -- especially with a pubescent boy at home who has found out that girls are SOMETHING who is needing a man around... he won't talk to anyone else, so he brings his issues to me ( thank the Lord he trusts in me enough to be honest and open)but I know it would be easier for him if dad was home. I know some of you can relate... plus my daughter has started to make up stories at school (way way way out there stories, covering up) about him, where he is, etc, when previously she never even mentioned it to anyone(she's five) who knows? I have a lot on my plate, and I just wish he was coming home now. He is entitled to those credits. He had 307 days credit plus an additional 83 ; that's 390 days.. he was requesting his primary 307. :shake: We dont want a new trial, we dont want to persue a legal battle citing both his PD and the DA (both were very negligent) or the Judge for that matter for not following the rules of court, when he primarily in fact questioned the DA's arrangements, and throughout repeatedly paused in confusion, asking the DA to clarify, yet he never asked for the verbal acknowlegment from my love that he supposedly was waiving his credits and to confirm he was knowlegeable to the repercussions. There was no johnson waiver, no verbal waiver nothing. Why won't they grant the stupid credits???? That's all we want; what he is legally entitled to.
