New York fined for mistaken prison release:
[World News]: WASHINGTON, March 4 : The state of New York must pay a total $5.5 million to a rape victim and the survivors of a woman killed by the man mistakenly let of out prison.
The decision by Court of Claims Judge Alan Marin, made public Thursday, claimed any number of state employees should have caught administrative mistakes that allowed Franklin Scruggs to be released in November 1997, the New York Post reported Friday.
Marin said the three children of Michelle Brey, who was raped and killed by Scruggs in September 1998, should be given a total of $3.6 million.The remainder of the damage award was ordered given to a rape victim who was attacked by Scruggs two weeks before Brey's killing.
The newspaper said Scruggs was serving a 20-years-to-life sentence for assault and reckless endangerment when one charge was thrown out and a judge ordered Scruggs re-sentenced.A judge's clerk apparently forgot about the additional conviction and issued an order for Scruggs' release.A prison clerk also missed the outstanding charge and Scruggs was released in November 1997, 10 months before Brey was killed, the Post said.
Scruggs is serving a life sentence for the killing and rapes.
