View Full Version : Court Fines Taken from Commisary?

if someone owes a court fine, can they take all the money we send or do they take half? my son is in wyoming and is stressing that they will grab all his money. i heard its 50% but im not sure. is this something you know?

someone has asked me this and I am not sure. Can someone answer this?

when you send money in if they owe a fine they will take half of whatever is sent in.......

My Husband Had An Agreement With Them So They Were Taking 50.00 From His Commissary Account Every First Of The Month Until His Fine Was Paid.

with Outtie....ANY time ANY money is sent they take half. If he has any outstanding bills....eg.headphones, tickets. they take a half of the half that goes to him so that he in the end gets 1/4.
$50.00.......sent in
$25.00......DOC takes off the top
$25.00 for him.........

then if he has say 1 tickets @$5.00 and then headphones @$3.00 they take that right away so
$25.00 minus the $8.00 that leaves him with $17.00 until he gets more money sent in.

Does all this make sense??????? Hope so!!

so does it depend on the inmate or an agreement or what?
I get what you both are saying, but it is different for both it seems...
how can you know? does the inmate get notified how it will be done?

the way it has been for me at Gowanda & at Downstate. they take 1/2 of any money sent to their account until the court fine is paid. Hope this helps.

I left $50 for Bub.. they took it all but $2.00 for a fine.. i think it depends on the person in charge.. who knows though....

From what I know each time money is put into The Duke's account half of it taken. It depends on the person, the charge and the agreement. So if varies for each individual.

i think they start paying restitution when they get out. depending on their sentence.the p.o. he gets will know how much and all that a week. but as far as them taking half of the money u put in comissary for fines or surcharges or whateva..they took everything i put in there until it was paid off he had no commisary money.maybe it depends on the facility>i dunno.

my experience has been in NY they take all the money you owe
every penny
they don't wait
and last I knew you had to pay for a DNA test around $100
50% of what's in the account is there's for the taking if anything is owed

but things change and facilities are different

here it's 10% of however much money you get put into your account, each time a deposit is made.

let's say for jan, you send 100.00 on the 1st, then 30.00 on the 16, then 50.00 on the 28th. they'll take out 10.00 on the 1st, 3.00 on the 16th, and then 5.00 on the 28th to pay for fines. each time you add money, they take out 10%...or you can arrange for more to be taken out to pay it quicker, but nothing less.

if you owe the prison for things such as medical...they take that full amount out whenever money is put into the account.

each prison and state is different, but here it's only 10%.

I think it was something like the first times funds are deposited into the inmate's account they take half, and like 25% each additional deposit into the inmate's account.

This sucks my boyfriend also has 50% on anything over $50 taken out. How in the world are they to afford things like TVs and radios? I will have to put $ 300 in just for these 2 items.

if he has more than one surcharge they take 100% of the money until the first surcharge is paid off, then they take 50% of the commissary to pay off the remaining surcharges.

I was just reading these postings about money now I sent in money to him he has a job there they took all his money he has nothing left he had said 50% for fines 50% for and sr chrg can they leave him with nothing? how will he buy things he needs that I can't send he's in Gowanda and has had problems since he got there 2 months and 1 week ago only 2 years 7 months to go!help please

Send as much as you can and be glad that the fines are going down before they get out. If they are unable to get a job right away when they get out and cAn not pay the minimum then they shouldn't be violated. Not sure this is just how I am seeing it.

they took all my mans money over 50 dollars he researched it and is writing a grievence because in the law library it says they are only suppose to take 50 % unless its court ordered. i dunno but i sent him 150 and go 0

but when he got to the max facility they took half for his surcharges and will take half till it's paid off... by the way it took 16 days for his money from downstate to get to him and his money from Riker's still hasn't gotten to him... but when it does they will take half... hopefully next month all his money will be his ... he only owes a few more dollars to the court fines and DNA database fee.. it's hard but just try to send a few extra dollars so they will at least have something for themselves and if you can send the basics through a vendor... what are they gonna do? take half a bottle of shampoo and half a bar of soap? lol .... j/k but imagine... rofl

I sent $30 to my man when he first went to downstate and they took the whole amount...so I don't ever send money cuz he said they take it all until the fine is paid off????

They usually take 1/2 and give them 1/2 until it's paid off.

My friends house had a lien put on it by the Courts for court ordered fines, and they took 50% of everything he received into his prison account for other monies owed..(dont know exactly what they were). We sent the stuff he needed until we could slowly pay down what they were taking the money out of the account for. Like sending $20.00 when we could instead of $15.00. That way they took $10.00 instead of $7.50. No matter how it gets done, we can never seem to "afford" to pay it up. It seems like a "lose.. lose" situation. Even with the postal charges, at least he got the shampoo, deotorant and such. his big sister

HI whenever me and my friends send my hubby send money, they take out more than 50%... Almost 90%!! The people in jail told him that it might be that he is likely to be released early so that's the reason why they are taking high percentage. Is that true????

Wit my man they took the first 50- for DNA he still owed mad money but now they only take 1/2 of everythin i send in.

It shouldn't be more than 50%. check him on that - he should get a print-out every now and then that shows the status of his account, his fines, etc.

In Wisconsin the Judge sets the amount to be taken. Most I have heard while waiting in court is 25%.

In NY they can take 100% of any money put into his Inmate Account, and 50% of any money he earns through his work program.

You can pay court mandated fines and fees, in two ways.

Contact the Court Clerk of the court where he was sentenced and make arrangements to pay the fines and fees.

Or you can deposit the amount in his Inmate Account and NYSDOC will take it out to pay the fees.

I paid the court fines the day they sentenced my boyfriend and they still took his money and they will not tell me why.

Do they always charge court fees? So EVERYONE gets money taken out of their account or what? Im just wondering how this works... A little freaked out now... Im poor as hell and can't afford to be sending him money that he wouldn't get anyway.

Damore, they won't tell YOU anythign, but they HAVE to tell your boyfried.
He will have to make a grievance if he does not know why his money was taken.

You must have proof, a receipt or statement that you paid the court fines, and he should have a copy of that, which will bolster his greivance.

If the money was taken twice for the same fees, then NYSDOC will have to reimburse him, but he has to first do something about it. He cannot just sit by and let it go.

My husband has been having money taken out of commissary forever and yes it's basically half of what I send. If I send 40 he only will see 20 of it. Thank God the fines is almost finish I will send the whole 100 in so he can have all his money.

Does he have restitution to pay? You may have paid only his court fees and not the restitution? Not everyone has restitution though.

I find this practice of taking inmate's money despicable!!.....especially in the Texas Dept. of Criminal Justice.......TDCJ!!! It's not bad enough that the inmates are not provided with basic hygeine items; but, they take the money that would be normally used to buy these things. Court costs, restitution, fines, etc. should in NO WAY BE TAKEN OUT OF AN INMATES COMMISSARY ACCOUNT!! In Texas, the inmates are given poor medical care, aweful food, concentration camp-like living conditions, non air conditioned & overcrowded living quarters, and are MADE TO WORK FOR FREE!! I don't see how they should owe ANYTHING! When I was locked up at BRADSHAW I remember how twice a week for breakfast we were served dry, breakfast cereal with water....not milk! If it wasn't for our families on the outside sending money to supplement the lack thereof we'd be in pretty bad shape. This ugly practice is not only robbing the inmates of the basic necessities, but also, robbing the inmate's families by making them feel the need to send more money to off set the sum that is taken( stolen) 'off the top' when money is sent by family and friends. TDCJ you are a crooked, and nasty agency............SHAME ON YOU!!........ANDRES MORIN III:angry:

I sent him a copy of the receipt when he was in elmira and he doesn't have to pay restitution. I made sure I'd payed it off before he left the county jail so this wouldn't happen. I don't have money like that to keep sending him so they can just keep taking it from him.
