When appealing, is the case usually heard before the same judge from the first sentancing?
Wouldn't you want to get a different attorney than you had the first time around to try the appeal?

I've been told by several individuals that you never use the same attorney who represented during the trial to the appeals process.

Appeals go to a "higher" court. Different lawyer, different judge(s)- at least in NY this is true, GOOD LUCK!!!
