:confused: HI I'M WONDERING IF ANYBODY CAN HELP ME MY BOYFRIEND IS INCARCERATED IN CALIFORNIA AND HAS HIS RESIDENCY BUT HE NOW HAS AN INS HOLD ON HIM AND WE FEAR HIM FACING DEPORTATION HE SHOULD BE GETTING OUT THIS COMING NOV BUT I DON'T KNOW IF I'LL SEE HIM THEN BECAUSE OF HIS STATUS WE HAVE A TWO YEAR OLD SON (BORN IN THE US) AND HIS MOTHER AND SIS ARE CITIZENS THIS WOULD BE HIS ONLY FELONY AND HE HAS BEEN HERE MOST OF HIS LIFE. I HOPE SOMEONE CAN HELP ME OUT ON THIS ONE. :confused:

Where is he from ??? I don't have a 100% sure answer to give you, but I know 2 members on this board, whose husbands are not American citizens (Italian and English), and who will be deported. :(

I feel that I must be honest with you...I hate to be the one to break the bad news, but yes, there is an extremely strong chance that he will be deported. My fiance came here when he was 9months old, he had residency and his father is a citizen and he was deported in 1997. What has your boyfriend been convicted of? That may be his only argument. Just keep in mind that inorder for him to fight the deportation he will have to deal with a long hard fight. I say t is worth it!!! What contry is he from? How old was he when his mother became a citizen? You will also have the argument that it will break up the family as his son is here. Please let me know and I will definately see if there is anything I can do to lead you in the right direction.

Thanks you two well let's see I"m not exactly sure of what conviction he got but it's mostly for a previous time and he went back in for violation of his probation I will have to ask him exactly what he got convicted of next time I speak with him. He was born in Mexico and he was like 23 when his mom got her citizenship.Another question is can we start doing anything now in regards to this or do we have to wait untill he's actually in INS custidy?

definately consult with an attorney now! Don't wait. If there is anything they can do they will need to begin the process now. I will say to be careful and do not hire an attorney until you have a consultation and are you of what they can/can not do for you. I asked when his mother became a citizen because if he was under 16 it may have helped. Find out what his charge was and I'll send you some info related if I have any. Let me know if there is anything I can do to help you guys out with this. I'm no expert but I have done a ton of research about immigration as it is a subject very close to my heart.
