I have 2 women in prison.

The first is my neice Lorrie Sue McClary, the 1st. juvenile (16) convicted as an adult in California. Convicted of murder and sentenced to 7 to life in 1975, she's been behind bar's 27 year's this Sept. 30th. Her co-defendant a 23 year old man was also sentenced to life but was freed in 1980. My neice is not guilty!!!!!

The second is my wife, Caroline Rose Homan (Anderson) was convicted of conspiracy to murder, sentenced to 25 to life in 1982. The State just did a Battered Womans Ssyndrome report on her and stated, "she didn't commit the crime"!!!

Both of these woman have almost 48 years together in prison, is there a corrageous lawyer out there.

This is my 1st. time on this site.

I doubt you'll find any lawyers hanging around in here. If you're asking how to go about getting and paying for a lawyer, you can probably get some tips in here. (I can help with that - from my own experience!)

You might want to try posting something at Prairie Law. There are lawyers who respond to the posts there, and they can also refer you to someone in your area. Here's the link.

Lorrie Sue was involved with the murder of my grandfathers sister - Mrs. Anna G. Mills. While I've been a battered wife myself I never killed blaming it on that syndrome. I don't understand the "justice" system allowing the actuall killer to be released so soon and Lorrie having to stay in so long. I feel she paid her dues but the killer did not. I've missed Anna for many years now. She was one of the kindest people you would ever care to know. All she thought she was doing was helping two young kids - what did she get for it? Besides, how hard it is to murder a 79 year old woman? Doesn't take much brains on that one.

I can't really help you with the innocent defendant. It depends on exactly what the issue is. For instance, Project Innocence in NYC are the go-to folks on DNA issues. A number of law schools have programs to review cases where the conviction seems decidedly sketchy.

Battered Spouse Syndrome is a hot Habeus issue right now; and I know of one case where a life term was recently turned into "time served". You want to know who teh Pro Bono Appelate attorney from Los Angeles (Beverley Hills) was in the Susan Greenberg case. The case was out of Placer County (Auburn), and that's where the Habeus was heard. A phone call to the Placer County criminal court clerk might get you that information.
Basically, the writ would allege that battered Spouse Syndrome wasn't a recognized defense at the time of the conviction (easy to prove with an expert). Then, the hard part. The basis for a solid Battered Spouse Defense has to be fully investigated. All witnesses, medical records need to be gathered. Experts need to be retained (which is why a Beverley Hills firm was doing the case). All that material is made part of the writ; and if a writ hearing is set all need to be in court testifying. (Still more expenses.)
You really ought to try to get the briefs from the Greenburg case. There's certainly no harm is seeing if you can follow in the footsteps of a writ that won.
