I just wanted to introduce myself and tell a little bit about my situation.
My name is Cindy. My husband is in a California prison for a crime he did not do. He is doing 25 to life.
It has been very hard on us all. We really need to have him home. I go to see him when I can.
My husband was convicted for a double murder. There are a whole lot of facts that did not get put on the stand. Evidence was tampered with, and witness where not put on the stand on his behalf. His uncle was put on the stand by the other side and when my husband's public defender went to question him, he took the 5th Amendment. It took a year for his case to go to trial. And only 3 days for them to reach a verdict.
He has someone in there helping him with his case and I have Project Innocent Act helping on the outside. They deal with wrongfully convicted cases. My husband had a loop holes in his case.
If anyone may be able to make any suggestions as to some help, please feel free to suggest away.

WELCOME TO PTO.... THIS IS A VERY SAD SITUATION THAT YOU AND YOUR HUSBAND HAVE.... KEEP FIGHTING IT EVERY DAY.
MY SON TOO, WAS TRIED FOR CAPITOL MURDER. HE SHOT AND KILLED HIS WIFE'S BOYFRIEND IN SELF DEFENSE. HE TOO HAD A TERRIBLE TRIAL AND A LOT OF EVIDENCE WAS NOT BROUGHT OUT. THE FACT THAT HIS JAW WAS BROKEN BY A BASEBALL BAT HIT B Y THE GUY HE SHOT WAS ONE THING ALTHOUGH THERE WERE MANY OTHERS THAT WERE NOT BROUGHT OUT.
WE NOW HAVE THE NORTH CAROLINA BAR ASSOCIATION INVESTIGATING ONE OF THE COURT APPOINTED ATTORNIES WHO DEFENDED MY SON. THIS ATTORNEY WAS AN ALCOHOLIC AND WENT TO TRIAL DRUNK ON MANY OCCASIONS. HE PUBLICALLY ADMITTED HE WAS ALCOHOLIC. THE BAR ASSOCIATION HAS 139 COMPLAINTS AGAINST HIM. HE WILL GET DISBARRED I AM SURE AND WHEN THAT HAPPENS, WE ARE HOPING BUTCH GETS A NEW TRIAL...
DON'T GIVE UP THE FIGHT.... IT MAY TAKE TIME, BUT THERE REALLY ARE SOME PERSONS OUT THERE WHO WILL BE WILLING TO HELP YOU. SOMETIMES YOU HAVE TO SEARCH A BUNCH BEFORE YOU CAN FIND THEM.

Welcome. I am sorry to hear about your husband. Have you tried a probono lawyer? I know someone who called every big time attorney in the country until one agreed to take her husbands murder case for free. It's like free advertising for them. Just a suggestion.
My thoughts are with you both.

msphilos2 06-04-2002, 01:07 PM I am very sorry for taking so long to respond back to all of you but I do want to thank all of you who have responded to me and welcomed me. Yes it is very hard for my husband and I. I finally got to see him Sunday after 2 yrs. It was a blessing.

Cameo 08-19-2002, 10:40 PM Another Welcome and glad you found us here! California has a lot of fine law schools, have you tried to contact them? Usually they have students who work on issues with their professors (lawyers/law professors) assisting them. I hope you can get the help your looking for!!

msphilos2 08-19-2002, 11:20 PM Yes Pamela I have looked into the California Innocence Project and we are waiting to hear from them. That was almost a year ago. So I guess no news is good news. Although his cellie has heard from them but denied him. So that is good news for us. He has someone working on his case in there and we do a lot praying. I want to check into the pro bono lawyers to see what I can find. I haven't lost hope or faith and help to keep him strong at all times.
