Calif. Judge Rejects Novel Appeal to Halt Execution


A federal judge Friday rejected a death row inmate's request to halt his
upcoming execution on grounds that a chemical used to paralyze condemned
prisoners during lethal injections could impair their free speech rights.

Barring a successful appeal, U.S. District Judge Jeremy Fogel's decision
means that convicted double murderer Donald Beardslee will be executed as
scheduled at San Quentin on Jan. 19.

Legal experts said Beardslee's appeal was the 1st argument of its kind in
death penalty law. But Fogel was unpersuaded, saying at a hearing Thursday
that Beardslee "hasn't shown a sufficient violation of his constitutional
rights." He took the case under submission and issued his ruling Friday
afternoon.

Beardslee argued in an application for a temporary restraining order to
halt his execution that pancuronium bromide, the 2nd of 3 chemicals
injected into condemned inmates at executions, could violate his First
Amendment rights by preventing him from telling witnesses that he was
uncomfortable or in pain.

But in a 7-page ruling, Fogel said he was unconvinced that there was any
chance that an inmate would be conscious when receiving the paralytic
drugs because doctors first administer a strong barbiturate, sodium
pentothal.

"Even with protocols under which only two grams of sodium pentothal -- as
opposed to the five grams used in California -- are to be administered,
the likelihood of such an error occurring 'is so remote as to be
nonexistent,'" Fogel said.

Senior Assistant Attorney General Dane Gillette had argued that Beardslee
must first prove an Eighth Amendment ban on cruel and unusual punishment
-- specifically, that an inmate is still conscious after sedatives are
injected -- before filing a First Amendment appeal.

"We're pleased, and we think this is the correct result," Gillette said of
Fogel's ruling.

Defense attorney Steven Lubliner of Petaluma plans to seek a review in the
9th U.S. Circuit Court of Appeals. He tried to convince the judge that the
state wanted to chemically mask the excruciating pain that condemned
prisoners endure during lethal injections.

"I'm surprised at the brevity of the order and its failure to engage in
any Ninth Circuit opinions or cases which make clear that development of
execution policies requires a vigorous protection of First Amendment
rights," Lubliner said Friday.

Beardslee was convicted of the drug-related slayings of 2 women in San
Mateo County 20 years ago.

The case is Beardslee v. Jeanne Woodford , CV 04-5381.

I hear that there will be rallies all over California starting today until midnight
tomorrow..It is sad that anyone has to be murdered by the state. Any state for
that matter. Maybe Ca governor will have a heart and stop this and all senseless
killings done by Ca Death Row. Why have a death row anyways? Ca is the least
to carrying out death sentences to begin with. It should just be LWOP. Most
death row inmates here in Ca die in prison before the state has a say in there
fate. And then San Quentin wants to expand Death Row and make a newer bigger one, I don't think that will change the way the state sits and doesn't take care of business to begin with. I understand that all death row inmates have to go through a appeals process, and that is good, but to toss away millions of dollars to build a new death row at San Quentin is just as wasteful
as what the state of Ca already does. May the angels shine down on the Gov
of Ca today, and stop the murder of Donald!

Gov. Arnold Schwarzenegger has denied clemency to Donald Beardslee.

Barring an unlikely intervention from the US Supreme Court, Donald
Beardslee will be executed this evening. Donald Beardslee, 61, is scheduled be put to death by injection at 12:01
a.m. Wednesday at San Quentin State Prison for the 1981 slayings of 2
women. More than 2 dozen public officials, members of the victims'
families and members of the media are scheduled to witness the execution.

Beardslee's remaining legal challenges before the U.S. Supreme Court
include claims that the lethal injection is cruel and unusual punishment
and that jurors were unfairly influenced when they rendered a death
verdict.

It would be the 1st execution in California since January 2002 and only
the 11th since the state reinstated the death penalty in 1977. More than
600 men are on the state's death row.

In his clemency petition, Beardslee's lawyers claim he suffers from brain
maladies when he killed Stacey Benjamin, 19, and Patty Geddling, 23. The 2
were lured to his Redwood City apartment to avenge a soured $185 drug
deal.

At a hearing Friday on Beardslee's request, Former San Quentin Warden
Daniel Vasquez called for clemency, saying Beardslee had been a model
inmate during his 21 years on death row and contributed to the safety of
guards and other prisoners.

"Donald Beardslee is the rare inmate," Vasquez said. "Killing him would be
a shame."

This is a sad night for all California prisoners and their families. May god have mercy on his soul. And that Mr. Beardslee rest in peace. Thank god that each
of us do not have to go to bed tonight that we murdered this man. I would hate
to have blood on my hands, to bad that the state of Ca doesn't see it that way.:angry:

It is heavy in my heart... a half hour now until they do the deed.

We Californians could always be in denial about the death penalty because we execute so rarely. But it is still the law of the land and we have not stopped it yet.

How strange that I am old enough to remember when the Supreme Court outlawed the death penalty in the 70s or 80s -- when was it? Why, oh why, did we ever go back to this barbarism?

Sad days indeed. I have a reporter friend who is there right now. It must be so hard.

The pain of knowing someone is soon to be executed is with us all and will remain with us until this barbaric practice parading as 'justice' is stopped once and for all. It is all over the news here in England also. How can they justify going ahead because, and I quote from your article here Softheart:

We have all heard the reports of this being very far from how it actually happens and the suffering that so often takes place at this stage.

I just hope that the Gov is proud of himself for gaining popularity and praise from something so cruel and heinous......

im really sad for what happened to beardslee. my heart is heavy with pain. i agree that he was wrong if he killed those 2 women, but the death penalty is not a way to heal any sore wounds nor serve any justice. my heart goes out to the victims and the loved ones, but im still sad for beardslee. killing him 20 or more years later is no serving anyone any justice. sorry....
